  • I. TECHNICAL SPECIFICATION CHANGE REQUEST NO. 118 The Licensee requests'that Appendix'B to ti.a operational Technical Specifi-cation be deleted. This chsnge supercedes Technical Specification _ Change Request (TSCR) 100A, LlL 209, submitted August 13, 1981. Therefore, TSCR 100A is hereby withdrasa. ,

1 II. REASON FOR THE CHANGE REQUEST The existing Appendix B of License DPR-50 consists of four sections covering definitions, limiting conditions of operation, design features and operating practices, and administration. The requirements addressed in Appendix B are totally non-radiological in nature and are also covered in the Licensee's NPDES permit PA 000 9920 which has been issued by the Pennsylvania Department of Environmental Resources (PaDER) under the authority of the Federal Water Control Act, as amended.

The proposed change is consistant with previous decisions of the NRC Atomic Safety and Licensing Appeal Board. See, e.g., Carolina Power and Light.Co.

(H. B. Robinson, Unit 2), ALAB-569, 10 NRC 557 (1979) and Tennessee Valley Authority (Yellow Creek Units 1 and 2), ALAB-515, 8 NRC 702 (1978). It is also similar to other technical specification changes previously approved by the' staff for such fncilities as Prairie' Island, Units 1 and 2 (Amendment 54 and 48 to DPR-42 and DPR-60 respectively) and Calvert Cliffs, Units 1 and 2 (Amendments 70 and 53 to DPR-53 and DPR-69, respectively).

This change request will eliminate the duplication of effort by the NRC with respect to those non-radiological environmental concerns for which other regulatory agencies have statutory responsbility. The request will also be consistant with federal policy to eliminate the duplication of paperwork and regulation.

III. SAFETY EVALUATION JUSTIFYING CHANGE This change does not involve new safety information of a type not previously considered by an NRC review of the facility nor does it involve a significant increase in the probability of consequences of an accident, or of a "signifi-cant" decrease in a safety margin of operation. This change, does not represent an unreviewed environmental question and will have no adverse environmental impact, as previously evaluated in the Final Environmental Statement of the License.

IV. AMENDMENT CLASSIFICATION (10 ".FR 170.22)

This change is administrative in nature. Since it is replacing a previous request for which a fee was paid, no additional fee is required.

V. IMPLEMENTATION PERIOD In view of past NRC actions on similar requests by other licensees and the need to eliminate duplicate regulatory involvement, it is reg sted that the NRC act on this requert by December 1, 1982.
