Dear Mr. Miller:

Your letter of July 29, 1982, requested remittance of a $f,000 license fee to f

support our application to operate Crystal River Unit 3 at power levels up to 75 percent Full Power with three operating reactor coolant pumps and the Reactor Coolant Pump Power Monitors (RCPPM's) bypassed. Your request was based upon viewing of our April 9,1982 submittal as a separate and single safety issue (i.e.,

apart from previous analyses supporting operation with the RCPPM's bypassed.)

Florida Power Corporation does not agree with your interpretation of applicable fees. Florida Power Corporation requested an amendment to allow plant operation with the RCPPM's bypassed. This involves a single safety issue (i.e., Departure from Nucleate Boiling Ratio (DNBR) margin associated with a loss of flow transient.) This single issue necessarily involves two subsets since the plant can operate with either three or four operating reactor coolant pumps. These two subsets were considered on separate schedules by the Office of Nuclear Reactor Regulation (NRR) in order to facilitate an accelerated review to return the plant to power following spurious plant trips caused by the RCPPM's. NRR requested further information to support three pump operation with the RCPPM's bypassed; thus prompting our April 9 submittal.
