DOCKET N05. 50-266 AND 50-301 EMERGENCY PREPARE 0 NESS EXERCISE SCHEDULE POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 Pursuant to 10 CFR 50.12, our letter of June 30, 1982 requested an exemption from the 10 CFR 50, Appendix E,Section IV.F. schedule raquirements for annual exercise of the Emergency Plan. Your Staff subsequently asked for additional information.
As mentioned in our June 30 letter, scheduling constraints experienced by NRC Region III, FEMA Region V, the states of Wisconsin, Illinois, Minnesota, and Michigan, and other midwest utilities within NRC Region III have limited the available schedule times for Emergency Plan exercises.
Point Beach Nuclear Plant will experience the following sche hling conflicts during the next 36-month period:
1.
Refueling outage for Unit 1 - November and December of 1982; 2.
Steam generator sleeving and refueling outage for Unit 2 - March through June 1983; and 3.
Steam generator replacement and refueling outage for Unit 1 - October 1983 through March 1984.
The Division of Emergency Government (DEG) of the State of Wisconsin has assured us that it is able to respond to any actual accident situation at Point Beach Nuclear Plant at any time.
However, as indicated in the attached letter, the DEG is reluctant to support an exercise during the summer of 1983.
The State of Wisconsin, Manitowoc and Kewaunee counties, NRC Region III, and FEMA Region V have also asked that, since the past two exercises in our area 8208190224 820809 lg 37 PDR ADOCK 05000266 F

Mr. H. R. Dznton August 9, 1982 were held during the winter, the next exercise be scheduled outside the December to March time period.
This detail supports the need to tentatively schedule the next exercise for September 20, 1983.
As we indicated before, this exemption remains within the spirit and intent of the regulation and would only provide a technical adjustment of the schedule.
Accordingly, we request your approval of the proposed schedule.

Dear Mr. Lipke:
This is to confirm our conversation regarding exercise scheduling during the sumer of 1983. The Wisconsin Division of Emergency Government would have great difficulty doing any exercising during the June 1983 to September 1983 timeframe because our State Union contracts come due at that time.
Any job action or potential job action by State employees puts a heavy and total workload on our Division.
That makes a nuclear power plant exercise impossible during the summer of 1983.
