L By letter dated February 16, 1988 GPUN provided the response to tl:e Notice of

Violation. contained in your letter of December 30, 1987. In our response we

stated the following:

"In follow-up meetings and discussions with your staff, we

have expressed our difference of opinion. Fundamental to

-the difference of opinion is the interpretation of 10 CFR

73.55(d)(8). Q believe the intent of this regulation

'

permits infrequent access to be controlled by means other

than a guard or watchman. Although in the future, access l

through this manway will be controlled by a watchman or a l

site Protection Officer and an access control list, GPUN i

intends to obtain a written interpretation from the _0ffice

L of General- Counsel.

GPUN believes this-is~an accurate interpretation of the. regulation. However,

- after further review we have detennined that agreement or disagreement from

the General Counsel with respect to our interpretation would not have a  ;

E lsignificant bearing on the particular circumstances. of this: violation. As 1

'such,: GPUN does not intend to pursue a fonnal interpretation from the Office

of General Counsel. Our corrective actions as identified in our February 16,
