Dear Mr. Herbein:

By letter dated November 21, 1978, you proposed certain facility

. modifications at Three Mile Island Nuclear Station to eliminate reliance on operator action following a small break LOCA. These i

proposed modifications consist primarily of installation of connecting piping between certain high pressure injection lines and installation 4

1 of appropriate check valves.

In addition, for Three Mile Island Nuclear Station Unit No.1 (TMI-1), you propose to relocate the point of admission of reactor coolant system nomal make-up flow from outside the Reactor Building in Loop 6 to inside the Reactor Building in the same loop. These. modifications were proposed by you as a replacement for electrical-type modifications previously proposed for accomplishing this same purpose in your letter of July 24,1978. The modifications proposed in your November 21, 1978 letter were also discussed with you at a meeting in our Bethesda offices on November 22, 1978. At that meeting you commited to perform testing following the modification to verify that the system could meet the flow split requirements assumed in the analysis o.f ECCS perfomance for the small break LOCA. This analysis, based on this assumec flow split, was previously found acceptable by the i staff as stated in the Modification of Conditions of Exemption issued on May 19,1978 for THI-1.

This is to advise you that based on our review of the information contained in your submittal, the information furnished during the meeting of November 22, 1978 and your comitment to perform the testing referred to above, we conclude that upon completion of installation of the modification for TMI-1 as described in your letter of November 21, 1978 and upon completion of testing to verify attainment of the flow split assumed in the analysis referred to above, the emergency cort cooling system for TMI-1 will be fully in confonnance with the requirements of 10 CFR 50.46.

2 Regarding the proposed schedule for implementation of these modifications at TMI-1, it is our view that reliance should be placed on operator action for the minimum practicable period of time. In addition, the existing Exemption will require renewal at the time of the next licensing action affecting the Exemption.

Such renewal, however, will require justification.

In this regard we note that your proposed schedule would not provide fr.,r imple-mentation of this modification until the refueling outage planned for late winter 1980 - one year beyond the upcoming refueling outage. Such a delay in implementation would require particular1.v strong justification. Accordingly, you are requested to provide i

the following information:

1.

The earliest date by which you could be prepared to initiate implementation of the approved modifications at TMI-1 assuming a routine schedule for design and procurement.

2.

As in 1, above assuming use of "special orders," and other measures as available to expedite preparations to the maximum extent possible.

3.

The extra cost of the expedited schedule as compared to the routine schedule.

4.

The minimum duration outage necessary to implement the approved modification and perform the necessary testing.

5.

The net increase in operating costs of the outage defined in 4, above.

In order that we may make an early detemination of an acceptable schedule for implementation of this modification at THI-1, you are requested to provide the above information within two weeks of receipt of this letter.
