APPENDIX A NOTICE OF VIOLATION  :

Vermont Yankee Nuclear Power Corporation Docket No. 50-271 Vermont Yankee Nuclear Power Station , ,

License No. DPR-28 .

During an NRC inspection conducted on July 3 - August 12, 1990, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and. Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990), the violation is listed below.

10 CFR 50.59(a) states that changes in the facility as described in the Final Safety Analysis Report (FSAR) may be made without prior Commission -

approval if the proposed change does not involve an unreviewed safety question. _10 CFR 50.59(b) requires a written safety evaluation"which r provides the basis for the determination that the change does not involve an unreviewed safety question, Additionally, Technical Specification.

6.2.6.d states, in part, that the Plant Operations Review Committee (PORC) .

shall' review proposed changes to plant systems which~ would require a t change in normal operating procedures.

Contrary to the above, Vermont Yankee Procedure AP-0155, Revision 13, Current System Valve and Breaker Lineup and Identification, allows changes to the facility to occur prior to the preparation and PORC reviews of written safety evaluations following the implementation of a valve lineup deviation .

, FSAR Figure 7.4-la describes HPCI-19 as normally closed and HPCI-20 as normally open.

The two examples collectively demonstrate an unacceptable practice of making facility changes as described in the FSAR prior to preparing a written ,

safety evaluation that the change does not constitute an unreviewed safety question.

This is 'a Severity Level IV Violation (Supplement I).

Appendix A 2 Pursuant to 10 CFR 2.201, Vermont Yankee Nuclear Power Corporation is'hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and if applicable, a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each.

violation: (1) the reasons for the violation, or, if contested, the basis for disputing the violation; (2) the corrective steps that have been taken and the results achieved; (3) corrective steps that will be taken to avoid further violations; and (4) the date when full compliance'will be achieved. If an adequate reply is not received within the time specified in this. Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration wi'll be given to extending this response time.

Under the Paperwork Reduction Amt of 1080, PL 96-511, the response directed above is not subject to clearaace by the Office of Management and Budget.
