SUBJECT: NOTICE OF VIOLATION  :

NRC INSPECTION REPORT NOS. 50-528,529,530/93-48

This refers to the inspection conducted by J. Sloan, H. Freeman, J. Kramer,

and A. MacDougall, of this office, and T. Alley, of the Department of Energy, '

,

on November 2 through December 6, 1993. The inspection included a review of

activities authorized for your Palo Verde facility. At the conclusion of the

inspection, the findings were discussed with those members of your staff

identified in the enclosed report. l

l

Areas examined during the inspection are identified in the report. Within l

these areas, the inspection consisted of selective examinations of procedures  !

and representative records, interviews with personnel, and observation of

activities in progress.

Based on the results of this inspection, certain of your activities appeared 'l

to be in violation of NRC requirements, as specified in the enclosed Notice of i

Violation (Notice) and enclosed inspection report. The violations involved i

two instances of the failure of licensed operators to follow operating  :

procedures. Although the violation involving the operator's failure to  !

adequately monitor the reactor coolant system draindown evolution meets the i

criteria in the NRC Enforcement Policy for enforcement discretion, it is being .;

cited to emphasize the importance of maintaining close operational control 1

during reactor coolant system inventory changes. The inspection also

identified two non-cited violations involving the operator's failure (1) to

independently verify a valve's position after its position was changed, and

(2) to verify the operability of alternate power sources when a emergency

diesel generator was taken out of service. We are concerned that each of

these violations (both cited and non-cited) involve. the failure to control or

complete operator actions during plant evolutions or changes to plant

configuration. Additional management attention may be needed to ensure that

operational controls are adequately implemented.

The inspection also identified a third non-cited violation involving the

failure to verify that a control element assembly was properly latched before  !

lifting the upper guide structure from the Unit I reactor vessel. We commend l

you for the scope and aggressiveness of your investigation and subsequent

corrective actions following this event.
