Dear Mr. Chairman:

During my testimony at the July 15, 1993 hearing before the Subcomittee on Clean Air and Nuclear Regulation, I indicated that the Commission had established a review group to evaluate various issues associated with the NRC's activities to encourage licensee's employees to come forward to raise safety concerns without fear of retaliation. The Comission has just received the report from the review group and is enclosing the text for your informa-tion. The Commission and the NRC staff have not yet had the opportunity to review the report in detail; however, the Commission intends to publicly release it shortly during the period of Commission consideration.

Even a quick review, however, indicates that this report represents a comprehensive examination of the issues involved in the NRC's program for protecting allegers against retaliation. The review team acknowledges the problems experienced by allegers and attempts to identify solutions, predominantly within the constraints of existing statutory and regulatory provisions and NRC practices, but also noting potential improvements in the procedures of the Department of Labor and improvements associated with potential new legislation.

The staff, including the Executive Director for Operations and the General Counsel, will consider the report and make recommendations to the Commission.

Aftcr the completion of the Comission's review, we will provide you our conclusions. Nevertheless, we wanted you to have access to this study so that you could review it concurrently with us.
