Dear Secretary O' Leary:

The Commission has had a review team of senior NRC staff members assess the NRC's program for protecting allegers against retaliation.

The review team was charged with providing their views as to whether the Commission has taken sufficient steps to create an atmosphere within the community regulated by the commission in which individuals with safety concerns feel free to engage in protected activities without fear of retaliation.

Some of the recommendations of the review team's report address the employee protection provisions of Section 211 of the Energy Reorganization Act of 1974 and may impact the Department of Energy.

Enclosed for your information is a copy of this report, which has been made publicly available.

The report has also been provided to the Senate Environment and Public Works Subcommittee on Clean Air and Nuclear Regulation.

The review team's report is currently under review by the Commission.

The Commission intends to have the review team brief the Commission on this report in a public meeting on January 31, 1994.

Thereafter, the Commission will consider the recommendations, and, if the Commission believes that legislation is needed, EYecutive Brar.ch views will be sought through OMB.
