A letter dated October 20, 1993 contained much of the information that the NRC had requested in their October 7, 1993 information request concerning the pressurizer safe end crack. At that time, the metallurgical evaluation report of the pressurizer power operated relief valve line safe end crack had not been completed.

Enclosure 1 to this letter contains the metallurgical examination report for the pressurizer safe end crack.

Combustion Engineering (CE), Incorporated considers the information provided in the Attachment I to the enclosed CE report to be proprietary (I page). In accordance with 10 CFR 2.790(b), to support the NRC withholding proprietary information, an affidavit from CE is attached. It is therefore requested that the CE proprietary information be withheld from public disclosure. Since only one page of the report contains proprietary information, Enclosure 2 contains the two cover sheets and the non-proprietary page for placement of the report in the public document room.

6. Public disclosure of the information is likely to cause j substantial harm to the competitive position of Combustion Engineering because:
a. A similar product is manufactured and sold by major pressurized water reactor competitors of Combustion Engineering.
b. Development of this information by C-E required thousands t

of manhours and hundreds of thousands of dollars. To the '

best of my knowledge and belief, a competitor would have to undergo similar expense in generating equivalent information.

c. In order to acquire such information, a competitor would ,

d. The information required significant effort and expense to i obtain the licensing approvals necessary for application of the information. Avoidance of this expense would decrease a competitor's cost in applying the information and I marketing the product to which the- information is '

similar data and analyses in support of their processes, methods or apparatus.
