NRC INSPECTION REPORT NOS. 50-413/90-20 AND 50-414/90-20

This refers to the Nuclear Regulatory Commission's (NRC) inspection of your

Fitness For Duty Program, required by.10 CFR Part 26, conducted by William

Tobin, Region II, on July- 24-26,.1990. At the' conculsion of. the-inspection,

the results were discussed at an exit meeting with those members of your staff

identified in the enclosed inspection report.

The inspection consisted of selective examinations of your. Drug and Alcohol

Abuse Policy, corporate and site implementation procedures, chemical testing

program, interviews with employees and contractors observation of your Medical

Facility and review of pertinent records and reports.

As described in the enclosed report,.we are pleased to note-numerous ~ strengths

in your program: the use of a lower cutoff level for marijuana than NRC .

requires, a medical evaluation of blood alcohol concentrations less than the

NRC required .04 precent, full time Employee Assistance Program - (EAP) .

Counselors are assigned to each facility, Fitness For Duty (FFD) training was

noteworthy as was the employee / contractor retention of- the training, and,'

finally, the NRC noted the professionalism and expertise of the medical staff-

and the Corporate and site FFD managers,

The NRC has identified an Unresolved Item relative to your procedure of

equating a self-referral to the EAp as a first positive drug test. While wt

understand this procedure received senior management approval

believe it

does not meet the intent of 10 CFR Part 26.25 in that it is not, "... designed

,

to achieve early intervention and provide for confidential assistance."

To

resolve the issuo we are proposing a meeting be held in NRC Headquarters at

I

a mutually agreeable date to discuss this issue.
