ANALOG TRIP UNIT DIVERSITY FOR< ANTICIPATED TRANSIENTS WITHOUT. SCRAM (ATWS) RULE (TAC NO. 59095)
By letter dated Novemb'er 18, 1988,- the staff forwarded the-results of our.
[
review of your submittals concerning:the Alternate Rod Insertion (ARI) and Recirculation Pump Trip (RPT) designs related to the James 'A'. FitzPatrick
. Nuclear Power Plant. The letter indicated that the design was not_ completely
" acceptable, but.that the issues were not of. significant safety significance to delay startup from the refueling outage. The letter requested:that modif.ications to address these issues be completed ~ prior to startup from the next (i.e., 1990) refueling outage.
Three. specific issues were described in the safety evaluation included with -
the -letter. One of these issues involved the design of the RPT System, one-involved the design of the ARI System, and the last_ involved the issue-of diversity.of the analog trip units.
It is our understanding that the first two issues will..be resolved through design modifications'to'the circuitry.
The NRC'is awaiting a description of the' modifications before acceptability _
can be determined.
By letter dated December 14, 1989, you' requested an extensionifor implementation I
)
of the analog trip unit diversity portion of the ATWS Rule,. noting'that the issue had not been resolved between the NRC and the industry, as of the date of your letter.. The staff has reviewed the circumstances of the issue,: and of your request, and has determined that your request is justifiediand,.
therefore, approved.
It will remain in effect until'the final resolution is-determined. At that time, actions to be taken and their schedule will_be addressed.
In your letter dated December 14. 1989, you also requested that an exemption

from the diversity requirements of'the ATWS Rule be granted.. We have determined that, based on the extension granted labove, the FitzPatrick l-

1 request for the exemption from the diversity requirements of-the ATWS Rule is premature and unnecessary at this time. You should, therefore, take the course of action based on the final resolution of this issue when it is promulgated.
