MYERS' REQUEST ] JULY 20, 1990 QUESTION 1: A July 17, 1990 memorandum from TVA to h'RC which refers to sefety-related cables at the Sequoyuah plant states: During a telephone call on July 17, 1990, Jack H. 00nohew of your staff requested that TVA provide the enclosed justification for continued operation related to safety-related cables installed at SQN. It is my understanding that this telephone call has not been backed up by a letter to TVA. documenting this request. .I The concerns that resulted in the July 17, 1990 request for TVA's July 17, 1990 justification for continued operation were-brought to TVA's attention by. the NRC. The lack of a letter l from.the NRC; if there is in fact no letter documenting the NRC request for a justification for continued operationi errears to permit TVA to define the issue. This is of particular significance =in that the matter now under consideration is one that relates to allegations to the effect that TVA presented the. NPC information pertaining to cables at Sequoyah that is inaccurate and incomplete. 3 Myers/HRR-PD11-4 07/27/90

y RESPCNSE: The verbal request-on July 17, 1990, for the Tennessee Valley Authority (TVA) to provide a justification for continued operation of Sequoyah has not been followed by a letter'to TVA. On July 16, 1990, TVA informed the NRC that the TVA calculation that selected the 15 " worst case" conduits which were tested'in 1987 at Sequoyah had misapplied the conduit selection criteria. After discussions within the NRC technical staff on July 16 and 17, 1990, the NRC staff requested that TVA provide ~ ajustification_forcontinuedoperation(JCO)forSequoyahbecauseoftheerrors in the TVA calculation. The NRC staff judged that the information warranted en immediate response by TVA and the concerns regardir.g the impact of these errers was suffic .tly clear that written explanation was unnecessary. The letter subsequent ~fy submitted by TVA documented the request made by the staff. The letter submitted by TVA arrived on the night of July 17, 1990. Early on ne morning of July 18, the Sequoyah-Project Manager and the technical stcff reviewed this letter to determine (1) if it addressed the concerns raised by the staff in i its verbal request and (2) if it was acceptable. The staff cont.luded that the letter sufficiently addressed the request made by the staff on July 17, 1990. TVA concluded in its JC0 that the licensing basis of the plant was not changed. t Further, adequate basis existed to conclude that the concern with the misapplied selection criteria did not alter its first conclusions regarding the Sequoyah i. cable testing proaram. The staff concluded that it was necessary to fully explore l L this issue and its significance in the meeting held en July 23, 1990. l The NRC staff also requested (on July 17,1990) that TVA participate in a neeting at the NRC Headquarters in Rockville, Maryland, to explain the extent of the errors in the 1987 calculations and the corrective actions by TVA to resolve this issue. This meeting (which was transcribed) was held on July 23, 1990, and included technical discussions concerning the issues addressed in the JCO. Myers/NRR-PDII-A ) 07/27/90

)Ij' j nJ ' Decause of-the short time between the NRC's request and TVA's response, and because the JC0 became the basis for subsequent detailed (and transct4bcd) ' discussions between TVA and the t!RC, the staff concluded that it was not necessary _ to dccument the original request to TVA for a JCO. QU_E,STION2: If the NRC has not sent to TVA a letter stating the specific nature of the flFC's concerns and requesting a justificatico-for continued operation, what is the explanation for the NRC not having sent TVA such a letter? RE,SPONSE: ~ The staff has not sent a letter to TVA detailing its concerns and requesting the justification for continued operation for.Sequoyah that it requested by telephone on July 17, 1990 and subsequently discussed in detail with TVA at the - neeting on July 23, 1990.
