Appendix NOTICE OF VIOLATION Commonwealth Edison Company Docket No. 50-295 Docket No. 50-304 As a result of a follow-up inspection conducted on May 10-14, June 18 and 25, 1982, in accordance with NRC Enforcement Policy, 47 FR 9987 (March 9, 1982) the following violation was identified.
10 CFR 50.54(q) states, in part, that, "A licensee authorized to possess and/or operate a nuclear power reactor shall follow and maintain in effect emergency plans which meet the standards in 50.47(b) and the requirements in Appendix E of this part."
10 CFR 50.54(s)(2) states, in part, that, "For operating power reactors, the licensee, State and local emergency re-sponse plans shall be implemented by April 1981..."
The Zion Annex of the Generating Station Emergency Plan (GSEP) (Rev. 1) dated April 1981 states, in Section 4.2, that " Agreements exist on file at Zion Station with several support agencies. These agencies and their support rolls are as follows...
the Zion Police, Fire and Rescue Department..."
Contrary to the above, during this inspection, the inspector observed that the licensee has no current agreements on file at the Zion Station with the City of Zion Agencies, e.g., Police, Fire and Rescue Departments.
As a result of this lack of written agreements, there is no acknowledgment by the above local organizations of their assigned emergency responsibili-ties.
This is a Severity Level IV violation (Supplement I).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written stats-ment or explanation in reply, including for each item of noncompliance:
(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Consideration may be given to extending your response time for good cause shown.
