SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 70 TO FACILITY OPERATING LICENSE NO. DPR_Z1 NORTHEAST NUCLEAR ENERGY COMPANY MILLSTONE NUCLEAR POWER STATION. UNIT 1 DOCKET N0'. 50-245
1.0 INTRODUCTION
By letter dated October 7, 1993, the Northeast Nuclear Energy Company (NNECO) submitted a request for changes to the Millstone Nuclear Power Station, Unit 1 I
Facility Operating License. The requested change would modify Operating License Condition 2.C(3), " Fire Protection," by deleting the existing wording of the license condition and replacing it with the standard wording provided in G;neric letter (GL) 86-10, " Implementation of Fire Protection Requirements."
2.0 BACKGROUND
By "B14408, Proposed,Deleted TS 3.12 Re Fire Suppression Water Sys, Spray &/Or Sprinker Sys,Carbon Dioxide & Halon 1308 Sys,Fire Hose Stations,Fire Protection Instrumentation & Penetration [[Topic" contains a listed "[" character as part of the property label and has therefore been classified as invalid.s|letter dated April 16, 1993]], NNEC0 submitted a proposed license amendment request which would modify the Millstone Unit 1 Technical Specifications in accordance with Generic Letters (GL) 86-10 and 88-12. GL 86-10 requested that licensees incorporate the NRC-approved Fire Protection Program in their Final Safety Analysis Report (FSAR).
GL 86-10 encouraged licensees upon completion of this program, to apply for an amendment to their operating licenses to remove unnecessary fire protection Technical Specifications. GL 88-12 provided the guidance to implement GL 86-10. The GLs also requested licensees to amend their custom fire protection license condition and substitute it with i
the standard fire protection condition proposed in GL 86-10.

was already consistent with the proposed standard found in GL 86-10.

letter dated October 12, 1993, the NRC staff issued Amendment No. 65 to the Millstone Unit 1 Operating License in response to NNECO's April 16, 1993, l
letter.
In the staff's safety evaluation, the staff noted a telephone conversation between NNEC0 and the staff on September 15, 1993, in which NNECO committed to submit the appropriate documentation to update the license condition.
The existing license condition did not reflect all the applicable dates for NNEC0 submittals and NRC safety evaluations. The safety evaluation also noted that in a letter dated October 7,1993, NNECO requested a revision to the operating J
license to update the license condition.
Based on NNECO's October 7, 1993, letter and the safety evaluation, the NRC staff determined that removal of the j
fire protection requirements from the Technical Specifications was acceptable.

' The following evaluation documents the staff's review of NNECO's October 7, 1993, amendment request.
3.0 EVALUATION NNEC0's October 7, 1993, letter stated that Operating Condition 2.C.(3), " Fire Protection" would be modified by deleting the existing wording of the license condition and replacing it with the standard wording provided in GL 86-10.
The safety evaluations cited in the revised license condition are those issued by the NRC staff in support of NNECO's Fire Protection Program as described in the FSAR, Full-Term Operating License Application, safe shutdown methodology, l
nnd request for exemptions to 10 CFR 50, Appendix R.
Therefore, since NNECO's proposed license condition is consistent with the standard license condition suggested in GL 86-10, the NRC staff concludes that the amendment request is acceptable.
4.0 STATE CONSULTATION
In accordance with the Commission's regulations, the Connecticut State official was notified of the proposed issuance of the amendment.
The State official had no comments.
5.0 ENVIRONMENTAL CONSIDERATION
The amendment changes a requirement with respect to installation or use of a facility component located within the restricted area as defined in 10 CFR i
Part 20.
The NRC staff has determined that the amendment involves no significant increase in the amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration, and there has been no public comment on such finding (58 FR 57854). Accordinoly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9).
Pursuant to 10 CFR 51.2?(b) no environmental impact statement or i
environmental assessment need be prepared in connection with the issuance of the amendment.
6.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that:
(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, l
and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
