PART 70 LICENSE RENEWAL AND FUTURE AMENDMENT (TAC NO. L21687)

This letter is to confirm the conclusions reached in our conference call of November 22, 1993, in which we discussed changes to your reactor and special nuclear material licenses.

As we understand, Massachusetts Institute of Technology (MIT) plans to receive additional enriched uranium for use in the reactor and is preparing an amendment application for its Part 50 license to allow its use.

This amendment application will also propose transferring the bulk of the special nuclear material from the Part 70 licease to the Part 50 license.

However, we understand that the Part 50 license amendment application will not be submitted for several months, pending completion of a criticality safety analysis.

We have concluded that the best alternative is to proceed with renewal of the Part 70 license, and that it be amended after the Part 50 license amendment is completed. Accordingly, you should complete your response to our August 19, 1993, request for additional information; a partial response was provided in your October 12, 1993, letter.

Specifically, items 2 and 4-7 should be addressed (see enclosure).

The additional information should be provided within 30 days of the date of this letter.

1 Request for Additional Information Application Dated October 25, 1990 Massachusetts Institute of Technology (MIT) i Docket 70-938 License SNM-986 1

The application should specify the period of time for which the license is requested. A license term of 5 years has been adopted by the Commission, as stated in the Federal Reoister (32 FR 7172, May 12, 1967), except in cases where a shorter period may be indicated.

Section 1.7.3 of the 1984 renewal application states that disposition of 2.

i tems A-1, E-1, E-2, E-3, L-1, and L-2 in Table 1.1-1 "is anticipated within a year or less"., Item 3.a), states that after disposition, a license amendment, application would be submitted to delete the items from the license. No such amendment application has been submitted. This section should be revised to reflect the current status of these materials.

Section 2.2 of the application should explicitly state the authority of 3.

the Reactor or Campus Radiation Protection Officer to halt any operation which he or she believes threatens the health and safety of personnel or the public.

Section 2.8 should include a mechanism to ensure that any corrective 4.

actions identified during the quarterly admini.trative audits and annual independent audits are taken in a timely manner.

In accordance with the renewal application letter, the experience statements of Lincoln Clark and Edward Kararian should be deleted from the application, and those of Kwan Kwok and Fred McWilliams should be added. The experience statement of John Bernard should be updated to show his new position as Director of Reactor Operations.

If there are any other changes to the Reactor Safeguards Committee, the membership list should be updated.

As discussed during the site visit of July 1,1993, MIT would like to remove License Condition 15, which requires refresher training for Health Physics Technicians every 12 months. MIT should request a license amendment for this change under the provisions of 10 CFR 70.34.

This request can be submitted as an amendment to the current license, as well as a revision to the renewal application.

The Escrow Agreement between MIT and the First National Bank of Boston, as described in the December 19, 1991, letter to NRC from Paul C.

Powell, and confirmed in an August 25, 1992, letter from James Schultz, Bank of Boston, to Mr. Allen S. Bufferd, MIT Treasurer's Office, should be updated to explicitly include License SNM-986.

In addition, the face value of the security should be corrected to total $12,500,000, which is the sum of $11,000,000 for reactor License R-37, $750,000 for License 20-01537-02, and 5750,000 for License SNM-986.
