Subject: EMERGENCY PREPAREDNESS INSPECTION 50-289/93-08

This letter refers to the announced inspection of the emergency (EP) preparedness program at

Three Mile Island Unit I conducted June 7-11, 1993, by Mr. J. Laughlin and others of this

I

office. The purpose of the inspection was to determine whether activities authorized by the

license were conducted safely and in accordance with NRC requirements. The inspection

findings were discussed with you and members of your staff on June 17,1993.

In general, the inspection focused on the EP program and on related actions taken during the

i

February 7,1993 plant intrusion by an unauthorized individual that resulted in declaration of a

i

Site Area Emergency. Specific areas examined during the inspection are identified in the

j

enciosed report. The inspection results are based on inspector observations, interviews with

!

personnel, and examination of selected procedures and records.

In regard to general implementation of the EP program, this inspection found acceptable

performance. Strengths were noted in management involvement, EP staff expertise, and

i

Emergency Response Organization management training.

During the inspection, two apparent violations were identified.

One violation related to

j

adequacy of fire protection exit provisions for two Control Room fire doors. This matter is

j

described in the enclosed Notice of Violation and should be responded to in accordance with that

Notice. The other apparent violation relates to the delay in callout of the emergency response

organization upon declaration of the Site Area Emergency on February 7,1993. This matter

is being considered for escalated enforcement action in accordance with the " General Statement

of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C.

Accordingly, no Notice of Violation is presently being issued for this inspection finding. Please

be advised that the number and characterization of any apparent violation described in the

enclosed inspection report may change as a result of further NRC review.

Ba:ed on the results of this inspection and the discussion between Mr. R. Rogan and Messrs.

James H. Joyner and John F. Rogge of this office on August 10,1993, we have scheduled an

enforcement conference in the Nuclear Regulatory Commission Region I office, in King of

Prussia, Pennsylvania, to discuss this matter with you. The conference has been scheduled for

August 24,1993, at 10:00 a.m. Our decision to hold an enforcement conference does not mean

i

that the NRC has determined that a violation has occurred or that enforcement action will be

i

taken. The purposes of the conference are to discuss the apparent violation, its cause(s) and

safety significance; to provide you the opportunity to point out any errors in our inspection

!

report; to provide an opportunity for you to present your proposed corrective action (s); and to

,

discuss any other information that will help us determine the appropriate enforcement action in

!

accordance with the Enforcement Policy. In particular, we expect you to address: (1) the safety

!

significance of the augmentation delay problem, (2) root causes and contributing factors, (3)

!

corrective actions and measures to prevent recurrence, and (4) matters in extenuation or

2

mitigation. In addition, the enforcement conference is an opportunity for you to provide any

i

iniormation concerning your perspectives on 1) the severity of the violation,2) the application

of the factors that the NRC considers when it determines the amount of a civil penalty that may

be assessed in accordance with Section VI.B.2 of the Enforcement policy, and 3) any other

l

application of the enforcement policy to this case, including the exercise of discretion in

!

accordance with Section VII. After the enforcement conference, you will be advised by separate

correspondence of the results of our deliberations on this matter.

!

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and

its enclosures will be placed in the NRC Public Document Room.
