NOTICE OF VIOLATION GPU Nuclear Corporation Docket No. 50-289 Three Mile Island Nuclear Station License No. DPR-50 During an NRC inspection conducted on June 7-11, 1993, an apparent violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR 2, Appendix C, this violation is listed below:

The Three Mile Island Unit 1 Operating License, Section 2.c(4), Fire Protection, requires the licensee to implement and maintain in effect all provisions of the Fire Protection Program as described in the Updated Final Safety Analysis Report (UFSAR).

The Three Mile Island Unit 1 UFSAR specifies that plant fire protection systems will comply with National Fire Protection Association (NFPA) and Commonwealth of Pennsylvania Codes.

NFPA 101, Life Safety Code, Section 5-2.1.2.1.2, states that a latch or other fastening device i on a door shall be provided with a knob, handle, panic bar, or other simple type of releasmg  !

i NFPA 80, Standardfor Fire Doors and Windows, Section 1-4, defines a fire door assembly as any combination of a fire door, frame, hardware, a.id other accessories which together provide a specific degree of fire protection to the opening.

NFPA 80, Section 2-8.2.1, states that only labeled locks and latches or labeled fire exit hardware (panic devices) meeting both life safety requirements and fire protection requirements shall be used.

Contrary to the above, from the time of installation of deadbolts o 1 Control Room Fire Doors C415 and C418 (date unknown due to incomplete licensee records) through June 10,1993, the licensee did not maintain in effect all provisions of the UFSAR fire protection program, in that the Control Room Fire Doors were not equipped with proper fire exit hardware. Specifically, Fire Doors C415 and C418 did not meet life safety criteria in that the locks were not fitted with simple releasing devices. Instead, they were fitted with deadbolt locks that required a key for unlocking from either side, thereby potentially impeding Control Room egress in case of fire.

Further, these doors had a three-hour fire rating and were equipped with locks that did not ha' e an equivalent fire rating.

This is a Severity I.evel IV violation (Supplement I).

Pursuant to 10 CFR 2.201, GPU Nuclear Corporation is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington D.C. 20555 with a copy to the Regional Administrator, Region I, wd a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the I corrective steps that have been taken and the results achieved, (3) the corrective steps that will -

be taken to avoid further violations, and (4) the date when full compliance will be achieved. If ,

an adequate reply is not received within the time specified in this Notice, an order or a demand for information may be issued as to why the license should not be modified, suspended, or i revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.-  ;
