ENFORCEMENT CONFERENCE REPORT NO. 99990003/93018(DRSS) AND NOTICE OF VIOLATION This refers to the Enforcement Conference conducted by Roy Caniano and other members of the Region III staff on July 6,1993, of activities at Evart Products Company authorized by a General License pursuant to 10 CFR 31.5 and to the discussion of our findings with you and your staff.
We have enclosed a report summarizing the discussion.
Based on the discussion during the meeting, we have concluded that a violation of NRC. requirements occurred for the unauthorized transfer (loss) of a static elimination device containing a nominal 10 millicuries (370 megabecquerels) of-polonium-210 on or about January 12, 1993. This violation is described in the enclosed Notice of Violation. A written response is required.
As discussed during the conference, the NRC considers control and security of devices containing radioactive material to be of utmost importance.

appeared, from our discussions, that some control and security measures had been implemented by your company prior to the referenced loss.
However, these measures were not effective as is evidenced by the recent loss.
The NRC i
expects that a licensee take appropriate measures to prevent losses of licensed material. Violations for the same or similar events in the-future may include escalated enforcement action consisting of chil penalties or orders.
In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter, the enclosures, and your response to this letter will be placed in the NRC Public Document Room.
The response directed by this letter and the accompanying Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
