SUBJECT: NOTICE OF VIOLATION
NRC INSPECTION REPORT NOS. 50-528/529/530/93-12
This refers to the inspection conducted by J. Sloan, 4. Freeman,
A. MacDougall, F. Ringwald, and B. Olson of this office, on April 27 through

May 31, 1993. The inspection included a review of activities authorized for
your Palo Verde facility. At the conclusion of the inspection, the findings
l
were discussed with those members of your staff identified in the enclo, sed
report.

Areas examined during the inspection are identified in the report. Within
these areas, the inspection consisted of selective examinations of procedures
and representative records, interviews with personnel, and observation of
activities in progress.
l
Based on the results of this inspection, certain of your activities appeared
to be in violation of NRC requirements, as specified in the enclosed Notice of
'
Violation (Notice). This violation involved the failure to test snubbers as
required by Technical Specifications and is of concern because you had-
addressed this issue previously, but did not identify the violations and
implement corrective actions.
In addition, one non-cited violation was
identified regarding an operator not following a procedure in response to the
April 21,1993, turbine trip in Unit 3.
The inspectors also identified two examples of weaknesses in operability
determinations.
In ene case, APS personnel determincd that a feedwater
isolation valve was operable without adequate assurance that it could perform
its safety functior..
In another case, we noted that the troubleshooting
performed to cor. firm the initial operability determination of a containment
hydrogen control valve was delayed even though the root cause of the
deficiency was not clearly identified. Although these examples did not
represent violations of NRC requirements, we are concerned that further
management attention is needed to ensure that operability determinations are
performed in a timely manner and consistent with guidance of Generic Letter 91-18.

The inspectors also identified that the assembly and accountability drill
conducted on May 26, 1993, to correct problems encountered during the. steam
generator tube rupture event, allowed a one-hour assembly period prior to

beginning the 30-minute clock for accountability.
In our view, this drill did
not demonstrate your capability to assemble and account for personnel within
the required 30 minutes. We strongly encourage you to assure yourselves that
you can meet assembly and accountability requirements during any future event.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your-

response, you should document the specific actions taken and any additional
-
actions you plan to prevent recurrence. After reviewing your response to this
Notice, including your proposed corrective actions and the results of future
inspections, the NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements.
In accordance with 10 CFR Part 2.790 of the NRC's " Rules of Practice," a copy
of this letter and the enclosures will be placed in the NRC Public Document

Room.
The responses directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, Pub. L. No. 96.511.
