REVIEW REQUEST - FINAL AMENDMENY TO 10 CFR PART 34, " SAFETY REQUIREM?.NTS FOR thDUSTRIAL RADIOGRAPHIC EQUIPMENT" This is in response to your April 6,1989 letter requesting consent /
concurrence on the final rule package for the final amendment to 10 CFR Part 34, " Safety Requirements for Industrial Radiographic Equipnent. " We concur on the rule package, with the exception of the coment below:
' In the discussion section of the Commission Paper to obtain Cornission approval of a Notice of Final Rulemaking, we recomend that the clause that. states e
"both the NRC and its Agreement States" be r. hanged to read "both the NRC and the Agreement States." -When the NRC enters into an Agreement with a Stata the NRC relinquishes the authority to regulate tie t
by-product material within the State. We believe the recomended cleuse n. ore clearly reflects 'the relationship between the NRC and the Agreemen.' States.
