Dear Mr. Matthews:

As you know, Duke Power Company recently filed a complaint against Westinghouse Electric Corporation concerning the defective steam generators ,

supplied by Westinghouse for use in the McGuire and Catawba Nuclear Stations.

(We have previously provided the NRC with a copy of that complaint.)

Westinghouse provided four Model D-2 steam generators for McGuire Unit 1. -four Model D-3 steam generators for McGuire Unit 2, four Model D-3 steam generators for Catawba Unit 1, and four Model D-5 steam generators for Catawba Unit 2.

With regard to this complaint, your letter of May 16,.1990 to Mr. H.B.

Tucker,.Vice President of Duke's Nuclear Production Department, states in part

-that:

At this - time, the NRC has no position on the merits of the complaint. However, we wish to remind you of your responsibilities under 10 CFR Part 21 and parts 50.72 and 50.73 for the review, evaluation, and reporting to NRC of defects in safety-related equipmerit, materials, and services which may be identified by you

  • at any time, including during the review and discovery process resulting from this complaint.

Duke Power interprets these statements as a general reminder of NRC licensees' reporting responsibilities, rather than as a suggestion that Duke Power has not fulfilled its NRC reporting obligations with respect to the defective steam generators. Please be assured-that Duke Power officials are cognizant of their NRC 1eporting obligations. If during the course of-discovery or litigation we' discover any defects or other information i reportable under either 10 C.F.R.- Part 21 or other applicable NRC reporting '

provisions, Duke Power will of course promptly provide such information to the Commission.

As you know, and as the public record reflects, Duke officials have been J communicating with the NRC Staff regarding steam generator problems at McGuire -

and Catawba for some time. We believe that all previous discussions and representations of-the deficiencies in these steam generators were complete, accurate and timely, based upon our then-current knowledge.  ;
