Dear Mr. Borchert:

As we indicated during the All Agreement States Meeting in Kansas City, we are planning to visit your office in Lincoln, Nebraska, for the purpose of discussing the State's overall low-level radioactive waste disposal program.

We will coordinate this effort with staff free our Division of Law. Level Waste Management.

We also plan to discuss, to the extent possible, the questions you raised in your letter of September 15, 1989, to Carlton Kammerer Director, State, Local and Indian Tribe Programs.

In this regard, we will review the status of several of our recomendations from the Nebraska program review of July 1988.

c s-This is to fo1Aow up our conversation of September 7, 1989 atethe Low-Level Wasto Dispusal Regulatory Workshop in Rockville, Maryland about my request for your assistance concerning the agreement and the Radiation Control Program and possible discussions with the State's Administration.

The following are items that need to be resolved:

1.

An explicit explanation of the agreement between the U.S.

NRC and the State including what is covered, identification of the responsible e.gency and the applicability to low-level

(

waste; 2.

Who is responsible in Eenraska, under the agreement, to ensure the compliance with all of the requirements of 10 CFR

.61, including licensing, financial assurances, monitoring and regulating a Low-Level-Radioactive Waste Facility; 3.

Who is responsible to ensure that the Environmental Impact Statement addresses the required items for LLRW; 4.

The qualifications of personnel required for the licensing and regulation for LLRW including salary levels comunensurate with the qualifications in order to attract, recruit, hire and retain the necessary personnel; 5.

The lack of having the appropriate regulations approved and in place and the implications for low-level radioactive waste disposal and the Radiation Control Program; 6.

During our program review of on ar ago, it was identified that we needed an additional staff p reon for the Radio-active Materiale Program.

Since that time we have received three major license applications for review.

We also have a compliance problem and an accident investigation with a broad scope licensee.

l staff person and the increased work load, our technical review of applications and amendments has started to decrease and.I am concerned that we may be missing some important and significant items during the review process.

The inspection program and schedule has also fallen behind as a result of this situation; and 7.

The importance, magnitude and significance of the licensing requirements for a low-level radioactive waste disposal site needs to be described and outlined to the State's Adminis-tration.

This needs to include the' licensing.and regulation of such a facility.

Also the qualifications of personnel and salary levels needed to obtain these personnel.

I believe that it is imperative that a meeting be scheduled at the earliest possible time and not later than November 15, 1989 to discuss the above items and appropriately resolve them, in order to adequately regulate a low-level waste disposal facility in accordance with the agreement and meet the milestones specified in the LLW Policy Amendment's Act of 1985.
