i APPEN01X A NOTICE OF VIOLATION l.I Combustion Engineering-Docket No. 70-1100 Windsor, Connecticut License No. SNM-1067 During the Nuclear Regule.ory Commission (NRC) inspection conducted on May 7-10, 1990, a violation of NRC requirements was identified.
In accordance with the " General Statements of Policy and Procedure for NRC' Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is' described below:
i.
10 CFR 74.31(c)(8) requires the licyme to " Independently assess:
l the effectiveness-of the material control and accounting system at least every 24 months. and document management's action on prior assessment recommendations."
Paragraph 2 of the licantee's current Fundamental Nuclear Haterial Control Plan, (approved under 10 CFR Part 74) requires that this assessnent:
be completed within 24 months of the completion of the previous assessment and specifies that the audit 11s complete when the final written report is submitted to the Vice President, Nuclear Fuel.
Contrary to these requirements,-the licensee failed'to compiete the~-
biennial audit within124 months of the previous rdit. Specifically..
u documentation of the January 1988 audit was dated March 7, 1988, while documentation of the audit > performed January 11-17, 1990 was completed after the beginning of this inspection and dated May 8 '1990. This 4
exceeds the 24 months required.
This is a Severity Level V violation (Supplement III).
Pursuant to the provisions of 10 CFR 2.201,- CE-Windsor is hereby required _to i
submit a written statement or explanation _ to the Nucleer Regulatory Commission, i
ATTN: Document Control Desk, Washington'. DC 20555, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and= should include' (1) admission or denial-of the violation, (2) the reason for the: violation if admitted, (3) the.
1 corrective steps which have been taken and the results achieved. (4) the

corrective steps which will be taken to avoid further violations.and (5) the date when full compliance will be achieved._ Where good cause is shown..
