Dear Mr. Crutchfield:
We are actively engaged in making a formal presentation to you of the Exxon Nuc1 car (ENC) Spray Cooling Heat Transfer Test Results Phase Il Facility and Test Data ENC 8x8 BWR Fuel. As you may know, a question exists as to whether or not the report contains proprietary information.'
You will find enclosed a letter to ENC that describes our position and the need to formally submit the information in the very near future.
As you can see, the subject report should be available to you soon.

Dear Mr. Edgar:
Pursuant to Article XIX of the Contract for the Supply of Fabricated Nuclear Fuel and Related Materials and Services (June 30, 1971) and JCP&L Purchase Order No. 1402 (July 2, 1976), this is to nctify our intention to transmit XN-NF-78-12, Spray Cooling Heat Transfer Test Results Phase II Facility and Test Data ENC 8x8 BWR Fuel, May 1979 to NRC as a part of our responses to the SEP Topic VI-7.A.4 Core Spray Nozzle Effectiveness on or before l
July 22, 1982.
l Your letter of June 10,1982 (SBE:125:82) indicated that GPUN must "obtain NRC's agreement to treat the document confidentially" (item 2) and " stamp the cover of the d'ocument ' Proprietary' " (item 3). We are not able to obtain l
NRC's agreement prior to our transmittal of the report to NRC in accordance with 10 CFR 2.790.
GPUN cannot file the appropriate documents since we are not the proprietor of the information.
If ENC wishes to propose that the report or a part be withheld in whole or part from public disclose, ENC shall identify the document or part sought to be withheld and submit an application for withholding accompanied by an affidavit in accordance with 10 CFR 2.790 Section (b) to NRC directly on or before July 22, 1982. Alternatively, ENC may wish to prepare a non-proprietary version of the report, as discussed in Article XIX Fuel Contract.
We would appreciate your prompt response on thie matter. We are notifying our process by sending a copy of this letter to NRC.
