Subject: Inspection Nos. 50-245/82-04; 50-336/82-06

This refers to the routine safety inspection conducted by Mr. J. Shedlosky

of this office on March 28, thru Hay 8,1982 at the Hillstone Nuclear Station.

Waterford, Connecticut, of activities authorized by NRC License Nos. DPR 21/DPR

65 and to the discussions of our findings held by J. Shedlosky with Mr. Mroczka

'

and other members of your staff at the conclusion of the inspection.

Areas examined during this inspection are described in the NRC Region I Inspection

i

Report which is enclosed with this letter. Within these area, the inspection

consisted of selective examinations of procedures and representative records,

interviews with personnel, measurements made by the inspector, and observations

>

by the inspector.

,

Based on the results of this inspection, it appears that one of your activities

was not conducted in full compliance with NRC requimments, as set forth in the

!

Notice of Violation, enclosed hemwith as Appendix A.

This violation has been

categorized by severity level in accordance with the NRC Enforcement policy (10 CFR 2, Appendix C) published in the Federal Register Notice (47 FR 9987) dated

March 9,1982. You are mquired to respond to this letter and in preparing your

response, you should follow the instructions in Appendix A.

The item described in the attached Notice of Violation Appendix A, involving

l

exceeding)a Limiting condition for Operation (Mode Changes while in an Action

'

Statement is classified as a Severity Level IV Violation. As indicated in

i

Supplement I of the NRC Enforcement Policy (10 CFR 2 Appendix C) significant

violations of this type can be classified as Severity Level III. However,

after careful consideration of the factors involved in this instance including:

i

the significance and interrelation of the affected Technical Specifications for

this specific situation; and the nature of the plant system degradation which

existed when the mode changes were made; we have exercised our judgement under

i

the NRC Enforcement Policy and have classified this violation as a Severity

~

Level IV. Similar violations of this type in the future may result in addi-

tional enforcement action.

Furthemore, we also note that the violation was

'

identified by you and reported in LER 82-08/01T; however, we are concerned

about the occurrence of this event and the need for appropriate training of

the operating staff to pmvent recurrence. Accordingly, we will schedule an

.

enforcement conference with you in the near future in order to discuss our

concerns in this regard.

The responses directed by this letter and the accompanying Notice are not

subject to the clearance procedums of the Office of Management and Budget

as required by the Paperwork Reduction Act of 1980, PL 96-511.

In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosures

will be placed in the NRC Public Document Room unless you notify this office

by telephone within ten days of the date of this letter and submit written

application to withhold infomation contained themin within thirty days

of the date of this letter. Such. application must be consistent with the

requimments of 2.790(b)(1). The telephone notification of your intent to

request withholding, or any request for an extension of the 10 day period

which you believe necessary, should be made to the Supervisor, Files, Mail

and Records, USNRC, Region I, at 215-337-5223.
