APPENDIX A NOTICE OF VIOLATION Florida Power and Light Company Docket Nos. 50-250 & 50-251 Turkey Point 3 and 4 License Nos. DPR-31 & DPR-41 As a result of the inspection conducted on April 12-16, 1932, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1932), the following violation was identified.

Technical Specification 3.9.2.h requires cetermination of I-131 and particulate activity released from the condenser air ejector when radio-activity is detected in the secondary system.

Technical Specification 3.9.2.i also requires that analyses shall be performed in accordance with Sections C-2 and C-3 of AEC Safety Guide No. 21. " Monitoring and Reporting of Effluents from Nuclear Power Plants",

which specifies that releases which potentially contain radioiodines and particulate activity should be sampled continuously through a particulate filter and iodine sampling device.

Contrary to the above, the Condenser Air Ejector Exhaust was not sampled continuously for radiciodine and particulate activity during the period of April 1, 1981 to April 16, 1982 when analysis of secondary coolant showed radioactivity.

This is a Severity Level IV Violation (Supplement VII.D).

Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this of fice within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged viola-tion; (2) the reasons for the violation if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
