Appendix NOTICE OF VIOLATION Monsanto Research Corporation License No. SNM-567 As a result of the inspection conducted on May 10-13, 1982, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violation was identified:
License Condition No. 14 requires that licensed material be transported in accordance with the provisions of 10 CFR 71.5.
10 CFR 71.5 requires, in part, that you deliver any licensed material to a carrier for transport, only if you comply with the applicable requirements of the regulations appropriate to the mode of transport of the Department of Transportation in 49 CFR Parts 170-189 insofar as such regulations relate to the packaging of byproduct, source, or special nuclear material, marking and labeling of the packages, loading and storage of packages, placarding of the transportation vehicle, monitoring requirements and accident reporting.
49 CFR 173.393(n)(1) requires that, prior to each shipment of any package, the shipper insures by examination or appropriate test that the package is proper for the contents to be shipped.
Contrary to this requirement, on March 19, 1982, you shipped a package con-taining licensed material without insuring that it was properly packaged.
Specifically, you shipped a Type B quantity of americium-241 (0.3 curie as normal form) in a Type A container.
This is a Severity Level IV violation (Supplement V).
The inspection showed that action had been taken to correct the identified item of noncompliance and to prevent recurrence. Co_isequently, no reply to this item of noncompliance is required and we have no further questions regarding this matter.
