Firs., yce emchasi:cd the fact that the six violations were related to the single failure to reccgnize the relation between the ceficient diarhragms arc the crersbilit.y of the high pressure coolant injection system.

Secondly you cuestioned the basis for a 25% increase in the base penalty.

We have considered your observation regarding the identification of six violations associated with the event.

Several of the violations apparently frustrated your program for early identification and evaluation of unusual circumstances and the remaining violations resulted from this failure of the system.

Their separate identification in the Notice served to delineate the scope of personnel involvement.

However, for the purposes of measuring future enforcesent action, the Commission will consider these vio'ations as one Severity Level III problem.

With regard to your cuestion of the basis for increasing the penalty by 25%, we believe the text preced,ing our statement that you "could reasonably have been expected to have taken effective preventive measures" supported the charge.

Considering the scan of time and the number of perscos involved and the variety of their technical expertise, our concern for the integrity of your program for investigation of effects of malfunctions increased.

The increased penalty emphasizes that concern.

We concur with your statements that: (1) the period of Violation A ended on September 11,1981; and (2) the period of Violation 0 ended on August 18, 1981.

Our records shall be modified accordingly.
