I have provided my professional qualifications as an attachment to this Affidavit. 3. I have reviewed the Evaluation Findings, San Onofre Nuclear Generating Station Offsite Emergency Response Plans Exercise, April 15, j 1982, prepared by FEMA, Region IX (attached hereto), transmitted to the l Staff by letter from K. P. Baskin, SCE, to the Director, Office of Nuclear Reactor Regulation, NRC, dated May 20, 1982. I have also reviewed the declaration of Mr. Jack Stowe (and attachments) appended to Intervenors GUARD and Carstens et al.'s Application For A Stay of Full Power License filed in this proceeding on June 1, 1982. l l 1 8206220077 820616 PDR ADOCK 05000361 l G PDR 4 i i

In his declaration, Mr. Stowe states that based on the exercises conducted in May 1981 and on April 15, 1982, it would take in excess of one hour and forty minutes "to complete the entire alert and nctify procedure to instruct our State Parks populations in the nearest five miles..." exceeding the criteria provided by NUREG-0654. The attachments to Mr. Stowe's declaration (which appear to be limited to the April 15th exercise with one exception) similarly reflect a view that this 15-minute alert and notify criterion cannot be achieved based on the April 15th exercise. It is not clear, however, whether the concerns expressed relate only to the requirements for prompt notification or to the time required to complete evacuation as well. 5. As reflected in the General Guidelines For Offsite Agencies, item 6, for purposes of the April 15th exercise, no sirens were to be sounded (Evaluation Findings at I-5). Similarily, the Guidelines for State Parks specified, in item 7, "no sirens will be activated and no public address system activated." (Evaluation Findings at I-12). The guidelines also provided that there was to be no involvement of the public in the exercise (Evaluation Findings, at I-5, item 2, and I-12, item 5). Further, with respect to the specific guidelines for State Parks, only regular on-shift personnel were to be actually involved and then only to the extent possible without overtime. (Evaluation Findings at I-12, items 9 and 10). 6. In view of the above guidelines, the April 15, 1982 exercise does not provide information relative to the ability to provide prompt public alert and initial notification (in that the exercise specifically excluded use of the available siren and public address systems) or relative l
- to the ability to accomplish an evacuation under actual emergency circum-stances (in light of the limited scope of the exercise and personnel parti-cipating).
It is my opinion, therefore, that in terms of the capability to provide prompt public alert and initial notification, the April 15, 1982 1 exercise does not establish that an inadequacy exists. Furthermore, it appears that the activities identified in the time line attached to Mr. Stowe's declaration can be carried out in about 47 minutes from receipt of notification from Southern California Edison; ,[ it is not possible, therefore, to determine what the basis is for Mr. Stowe's statement that over one hour and forty minutes would be required to complete the " alert and notify procedure." 7. PROFESSIONAL QUALIFICATIONS David B. Matthews I am emp.loyed as Chief, Emergency Preparedness Licensing Section "B", Emergency Preparedness Licensing Branch, Division of Emergency Preparedness, U.S. NRC, Washington, D.C.. I attended the University of Virginia, Charlottesville, Va., and received a B.S. degree in Electrical Engineering in 1970. I then attended Cornell University, Ithaca, N.Y., and received a M.S. degree with a major in Electrical Engineering in 1972. I assumed my present position in July 1981. My. duties include supervision of personnel responsible for review of applicant and licensee plans prepared in response to those portions of 10 CFR Part 50 related to emergency preparedness at nuclear facilities. I am also responsible for managing and directing the on-site review of emergency preparedness programs to assure compliance with Commissioners requirements - both as they afply to operating reactors and as they are required to be implemented prior to issuance of an operating license. Prior to my present assignment, I served as Chief, Reactor Security Section, Division of Safeguards, U.S NRC. In this capacity I was responsible for supervising the review of reactor security programs developed in response to the requirements i contained in 10 CFR Part 73.55. These requirements include provisions'for physical security hardware and programs, contingency plans, and guard training and qualification programs. My previous assignments within the NRC, prior to May of 1980, included duties of increasing responsibility in the area of nuclear power plant and fuel facility security, safeguards and contingency planning.
These duties began with my initial assignment as a NRC plant protection analyst in August 1975. Between,1972 and 1975 I was employed as an electrical engineer with Westinghouse Electric Corporation in Hunt Valley, Md. My final position with Westinghouse was with the Nuclear Instrumentation and Control Department. 9

- sr~ _ _ - = \\ ( Mr. Frank Miraglia May 20, 1982 By letter dated March 31, 1982 from Mr. K. P. Baskin to Mr. Frank'. Miraglia, SCE provided the NRC with 63 copies of its functional description of the upgraded emergency support facilities for San Onofre Nuclear Generating Station. This report, which is not enclosed, clearly indicates that the caamunications system for the new Emergency Operation Facility (EOF) will be equal to or better than the communications system for the interim EOF. Tne operating procedures currently implemented for the interim EOF will be adapted for the new EOF prior to the operable date for the new EOF. Finally, on April 15, 1982, an Offsite Emergency Response Plans Exercise was held regarding the San Onofre Nuclear Generating Station. By letter dated May 3,1982, Mr. Robert L. Vickers, FEMA, submitted the FEMA Findings and Evaluations on this exercise to Mr. F. K. Massey. Overall, FEMA observations concluded that all jurisdictions reflected an adequate or better capability to respond to an offsite emergency at San Onofre Nuclear Generating Station. The May 3,1982 letter is enclosed. On May 14, 1982 the Atomic Safety and Licensing Board (ASLB) in its Initial Decision, authorized the Director of Nuclear Reactor Regulation to issue full-power licenses for San Onofre Units 2 and 3 subject to certain conditions. It is SCE's belief that the information enclosed with this letter provides sufficient information for the NRC to confirm to the ASLB that ASLB conditions C.3 and C.4 on page 215 of the ASLB Initial Decision have been satisfactorily resolved. They were reviewed by the RAC Chair =an, TEMA Regional Director, and are refle:ted in the follewing pages. No findings were made reflecting recommendatiens for ccrree:Ive action. Juris-di:tions should establish corrective action dates as they fit into existing t raining plans. s. .v. A. GENERAL FINDINGS Finding: Users of the Yellow Net were overloading the net and not allowing the Net to be used for conferencing and decision =aking. Reco==endation: Yellow Net should be reviewed for use and priority handling. The Net should be used initially to trans=it critical information to all users only until the EOF /ODAC is operational. After that the Net should only be used for decision making and joint conferencing between key parties of each jurisdiction. Further training and review of procedures should be acco=plished incident to quarterly ~ and se=i-annu.'l drill activities to assure correct use. B. SPECIFIC FINDINGS 1. San Diego County a. Finding: San Diego County persennel perfor=ed in a highly sat is f ac t ory =anner. Observations =ade were favorable findings regarding EOC briefings, PIO operations, and the effort expended by all staff = embers to address and handle cerrective ac tion ite=s fro = the previous exercise. R e c o==end a t i o n : None 2. San Juan Caoistrano a. Finding: For=s for Yellow Net co==unications were not those being used by the trans=itter. Reco==endation: Appropriate and use standardized =essage for=s to assure r=ooth handling of =es sage traf fic. 3. State Parks and Beaches a. Finding: So=e heavy co==unications traf fic was observed over the radtos being used for State Parks response. It appeared that the communicators could be overloaded and possibly miss key tranr=issions or a delay could be created in the response effort. Reco==endation: The State Parks and Beaches personnel review the current physical co==unications arrange =ent to assure staff can handle all radios trans=itting/ receiving at the sa=e ti=e. Consideration should be given to physically separating radios to assure opti=al handling of heavy co==unications traf fic dur-ing an emergency. 4 United States Marine Corp, Ca=p Pendleton: s. Finding: Field communications between the EOC and field coe-ma nd e r s, and the EOC and field =enitoring tea =s was weak to non-existant. Recommendation: SuFgest either modification of switch location, tightening of switch movement to avoid inadvertent movement, or posting of a warning to preclude such events in the future. b. Finding: No status boards were used at the EOC. Reco==endation: Install, staff, and use status boards for events and weather data to assure ease of reference and information to all staff at the EOC. 5. City of San Clemente a. Finding: Sirens were activated prior to development and issuance of an EBS message. Recommendation: That manage =ent assure the development and re-lease of EBS messages to the radio station, prior to activation of the siren warning system. Coordination and handling procedures for EBS messages with OranFe County should be reviewed to assure an operational process exists that will preclude such future proble=s. b. Finding: No individual was assigned responsibility to post and maintain status boards in the EOC. Key staff were often observed posting information. Recom=endation: Th a t a staf f member (s) be assigned responsibility for maintaining status board (s) in the EOC. 6. Orange County
- a. Finding:
Status boards were not maintained in the early part of the exercise (One hour and 23 c:nutes lapsed after the EOC was activated before first entry made). Recommendation: Attention be given to timely posting and main-tenance of status boards in the EOC.
- b. Finding:
Protective action information did not clearly define instructions to public in terms relating to public information brochures. Orange County - Continued Recommendation: That the EOC consider the ODAC director to be his operational emergency assignment (verses or not a county employee) and that proper channels be utilized to gain technical information durinF an emergency. a. FindinF: The County emergency medical services was represented -O at the EOC, but it had an of fice outside the main room and was not actively included in the exercise. Recom=endation: All agencies having functional responsibilities the EOC should have a liaison or representative located in the at main operations room. b. Finding: The Rumor Control facility was not obtaining and trans-zitting current updated information. Recom=endation: That review and action be taken to assure Ru=or Control has current informat ion at all times for release to the public. 7. EOF /CDAC a. FindinF: EOF operations did not provide for clear, t imely, and informative handling of information from the ODAC, for coordination to the liaisons, or general decision making at the EOC's. The Yellow Net was not properly or efficiently utilized. Liaisons had no access to the Yellow Net infor=- ation, ODAC infor=ation was sketchy at best and not jointly discussed, and little discussion was ef fected by liaison regarding joint actions or coordinated ef fort relating to unilateral activities. Recommendation: That the EOF liaisons be brought into the " mainstream" of communications and properly utilized as coord-inators and resources for information to/ from the EOC's. Briefing should be given periodically to assure a coordinated staf f of liaison personnel. b. Finding: ODAC informational releases did not ef fectively contribute to the decision making process on a frequent basis. Recom=endation: ODAC should serve as the source of technical recommendations to the EOC's. All technical data free the TSC should be routed to the ODAC for review and dissemination. This allows the ODAC to consolidate information from its various sources and release only one opinion or statement, eliminating the confusion of "who released this?", "has it been checked by ODAC7", etc. c. FindinF: Radiation data plotting did not reflect a time-date group. Recom=endation: All plotted information should reflect the time It was taken and/or time plotted to assure clear, updated information. 11-3

Recommendation: That the EOF director give update briefings to the ODAC at intervals of 30-minutes and when major significant events occurs. e. Finding: There was poor lighting in the ODAC. Recom=endation: In light of the temporary nature of the ODAC/ EOF f acility, consideration should be given to planning (only) for lighting to be upgraded in case of an " emergency" activating the EOF. f. Finding: The ODAC did not accept responsibility, nor did the TSC transfer the accident a s se s sment function to the ODAC/ EOF once the ODAC was operational. Recom=endation: That the procedures and policies for accident a s s e s s=e nt and ODAC/ EOF operations be reviewed and action taken resulting in the ODAC/ EOF assu=ing responsibility for accident a s s e s s= e n t. g. Finding: Participants in the exercise were not readily identi-fiable. This prevented timely handling of messages due to cuestions of authority. Recommendation: All participants should wear name tags that are clearly readable at a distance. Tags should indicate function and reflect authority to direct actions during emergencies. h. Finding: Hard copy transmissions were excessively delayed. Recommendation: Action should be taken to review process for hard copy transmissions to reduce 20-minute time delay. 8. Field Monitering Teams a. Finding: The Field Monitoring Teams adequately displayed, conducted the surveys, recorded the information and trans-mitted the results. However, in order to gain confidence and beprove tes= members' proficiency, more practical hands-on-training should be provided to the field team personnel. Recommendation: That additional training, SPO's and checklists be developed to assure an in-depth ability to respond to monitor-ing requirements during an emergency. 1 o' 9. Suggestion Pathwav Monitoring Drill - conducted by Orange County and ODAC staff. a. Finding: Teams reflected a basic knowledge of monitoring cap-ability. Some training is reco= mended regarding handling of radio communications between field teams and ODAC. Recommendation: Teams be given training and practice (including written guidance on terminology) relating to. radio communications. _ b. Finding: Procedures were somewhat confusing regarding handling of samples in contaminated and uncontaminated surroundings. In light of real time circumstances it is suggested that procedures be reviewed and new guidance developed. ODAC staff and planning personnel should contact the EPARAC member for consultation in planning development. c. Finding: Only Orange County personnel participated in the drill. Recommendation: Related counties and State Division of Radio-logical Health should actively coordinar e, develop, and participate in all future ingestion pathway training and exercises. State planning should be integrated into local jurisdiction planning at the earliest op por t unit y. Il-5
