Dear Mr. Haynes:

In accordance with Title 10, Code of Federal Regulations, Part 20 Section 20.403(b), the following confirms notification to Mr. Greenmaa of your office by Mr. Kevin Burke of Consolidated Edison of a reportable

occurrence on June 2, 1982.

Con Edison is presently engaged in the installation of new fuel racks in the spent fuel storage facility. This activity requires the movement of spent fuel within the spent fuel pool, removal of existing fuel storage racks and the installation of new fuel storage racks. In order to perform these activities, some of which must be conducted underwater, Con Edison's contractors had employed divers for inspection and construction activities within the spent fuel pool. On June 1,1982 a diver, who was employed by a contractor, was exposed to radiation in excess of the limits set forth in 10CFR 20.403(b). This exposure occurred while the diver was engaged in the installation of new fuel racks.

Prel.iminary estimates, based on readings from thermoluminescent devices, indicate that the worker may have received a whole body exposure of 8.6 Rem on June 1.

The estimate of the quarterly exposure to the worker is 9.4 Rem.

A preliminary investigation of the incident revealed that one spent fuel assembly which had been moved on May 31 had been improperly relocated.

The fuel assembly was placed in a storage location which sas closer to the diver's work area than had been intended. Radiation surveys inside the pool conducted before and during diving operations on June 1 did not indicate any unusual radiation level.

. The investigation is continuing to determine the exact cause of the exposure and what actions must be taken to prevent recurrence. All diving operations have been suspended pending the determination of the cause of the exposure and the implementation of corrective action.

Attachment A to this letter contains the name of the worker who received the exposure described above. In accordance with 10CFR 2.790(a),

correspondence to the NRC which identifies the name of an individual, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy, are exempt from disclosure. We understand, therefore, that the attachment to this letter will not be placed in the Public Document Room and will receive limited distribution.

We will continue to keep NRC Region I inspectors apprised of the results of our continuing investigation and will submit a report of the results of the investigation when the investigation has been concluded.
