Gentlemen:
By letter dated May 26, 1982, the Division of Licensing (DL) staff approved your application dated April 8,1982 as supplemented April 16, 1982, and issued Amendment Hos. 70 and 53 to Facility Operating License Nos. DPR-53 and DPR-69. This application requested deletion of certain nonradiological water quality surveillance requirements from the Technical Specifications for Calvert Cliffs Huclear Power Plant Units 1 and 2.
A Class III fee
($4,000) and a Class I fee ($400) were remitted with your application pursuant to 10 CFR 170.22.
It has been detemined that fees should not be charged for deletion of nonradiological water quality conditions in cases where licensees have k.i effective HPDES permit. On this basis, te have concluded that an exemption, pursuant to 10 CFR 170.ll(b), from the fee requirement is authorized by law and such exemption is otherwise in the public interest and is hereby granted for your April 8,1932 application. Therefore, we have concurrently authorized the Division of Accounting and Finance to refund the $4,400 paid with your application. Refunds are generally processed within a two-week period.
