g We have received a copy of your applic 'ijp7d ted Ju 10, 1981, which was filed with the Office of Huclear Reactor 6 ati ~ OMRR) for review. The application proposed Technical Specification c anges relating to (1) surveil-lance requirements on the auxiliary feedwater pump turbine speed switches, (2) setpoint index for pressurizer electromagnetic relief and code safety valves, and (3) surveillance requirements for the emergency diesel generators.
Three Class III fees ($12,000) were remitted with this application pursuant to 10 CFR 170.22. By letter dated February 12, 1982, the Toledo Edison Company withdrew that portion of the July 10, 1981 application relating to setpoint index for pressurizer electromagnetic relief and code safety valves.
Under the provisions of 10 CFR 170.12(a), the USNRC may retain fees for with-drawn applications. However, the ONRR review staff has informed us that no review of your July 10, 1981 application had cotwenced when it was withdrawn.
-0n this basis, we have concluded that an exemption pursuant to 10 CFR 170.11(b) from the requirements is hereby authorized by law and such exemption is other-wise in the public interest and is hereby\\ granted for that portion of the application relating to setpoint index for pressurizer electromagnetic relief and code safety valves. Accordingly, we are concurrently authorizing the Office of the Controller to refund $4,000 to your Company. Refunds are generally processed within a two week period.
We note that your Company plans to reinitiate this request at a later date.
At such time as this is done, fees pursuant to 10 CFR 170.22 should be addressed.
