An inspection of your licensed activities at your Orem, Utah facility, con-ducted by Mr. D. B. Spitzberg from the NRC Region IV (Arlington, Texas) office on January 8,1981, led to the identification of three violations of NRC re-qui rements.

One of these violations had been identified in a previous inspec-tion that was conducted on February 16, 1977, and its recurrence led directly to another of the violations identified.

A separate matter of concern involved failure to carry out certain commitments made to the NRC to take corrective action for a previously identified violation.

This failure to carry out comitments, and the repetitive nature of the violations indicate that control of your licensed activities is inadequate to assure compliance with NRC regula-tions and license conditions and is the basis for this Notice of Violation and

the Enforcement Conference held on February 24, 1981.

One of the violations identified during this inspection concerns failure to conduct surveys necessary to maintain levels of radioactive material released to unrestricted areas below the regulatory limit and contributed to an annual release that exceeded the limit..This release constitutes another of the violations.

These violations are of the Level III Severity and generally lead to a Proposed Notice of Civil Penalty.

However, in this case, we believe that the imediate actual threat to the health and safety of the public, or to your personnel, does not warrant such action at this time.

Of more concern is your failure to maintain the corrective action you stated you would take subsequent to our inspection and Notice of Violation dated February 25, 1977.

As you know, the corrective action you failed to maintain was cesigneo to prevent a recurrence of the violations that were detected during the current inspection.

Spitzberg, Radiation Speciali t, Region IV The purpose of the meeting was to discuss safety, licensee compliance with regulatory requirements, proposed corrective measures (including schedules for implementation), and other enforcement options available to the NRC.

The Notice of Violation attached to this report lists each of the violations identified during the January 8,1981, inspection.

In your reply to this letter you are required to follow the instructions contained in the final paragraph of the Notice of Violation.

In addition to your reply to the specific violations listed in the attached Notice of Violation, please describe the steps you had taken, or plan to take, to assure lasting ccmpliance in these areas and to minimize future violations with NRC requirements.

Your written response to this letter, in addition to dealing with the specific violations in the Notice of Violation, should provide detailed steps you have taken, or plan to take, to assure that any future cor-rective action connitments are fully implemented.

Also, your written reply to this letter and the findings during future inspections at your facility, will be the basis for determining whether additional enforcement actions (such.as civil penalties or orders to suspend, modify, or revoke your license) are warranted.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosures will be placed in the NRC's Public Document Room.
