l In July 1981 the staff fomarded a preliminary copy of Section 5.4.7 of the Midland Plant Draft Safety Evaluation Report. That section contained the following open item in regard to the decay heat removal system design:

" Manual action outside the control room in the absence of a postulated single failure of a safety grade system is not consister.t witn BTP RSB 5-1.

The present design requires that the operator leave the control room to open DHR suction valves, restore power to the DHR heat exchanger bypass valves, align the Emergency Boration System, and actuate the Auxiliary Pressurizer Spray.

Provide modifications so that these actions can be performed within the control room, or propose alternate qualified paths by which these functions can be performed from the control room."

In an August 7,1981 letter from Mr. R. A. Wells, Consumers Power Company responded to the above open item by stating that the system as designed is believed to meet NRC requirements because of the long time frames available for the operators to take the required manual action outside the control room.

The staff has reviewed your response to the subject open item. Our inter-pretation of GDC 19 continues to be as reflected in Branch Technical Position RSB 5-1 and is that plants should have the capability to achieve cold shutdown from the control room. For plants docketed before January 1,1978, and for which OL issuance is expected after January 1,1979 (Class 2 plants), the BTP pemits manual action outside the contro11 room after a single failure.

We have required recent NT0L applicants (i.e., Diablo Canyon and Summer) to meet this position. We permitted an exception in the case of San Onofre in the event of loss of offsite power since the manual action would be in close r203120062 820302 PDR ADOCK 05000329 A

proximity to the control room. In the case of liidland, manual action would always be required outside the control room to achieve cold shutdown. The action would be to open remc,te manual valves in the DHR suction line which would be required at approximately six hours into the cooldown procedure to achieve cold shutdown within 3G hours. The valves are not within close proximity to the control room (6 flights of stairs down in the basement of the auxiliary building - see attached drawing). Our position continues to be that the design is not in conformance with GDC 19 and is therefore unacceptable. An acceptable design would be to equip the valves with motor operators which could be positioned from the control room.

As you know, the staff is expending a great deal of effort to meet the expedited issuan.ce date of May 6,1982, for the Midland SER.

It would be beneficial for this open item to have been resolved (or at least reduced to a confirmatory open item) prior to SER issuance. Your action is required to bring this item to resolution with the staff.

I am willing to discuss possible near term courses of action with you as soon as possible.
