SEABROOK STATION, UNIT NO. 1 - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC M85020)
By your appilcation dated February 2, 1993, you submitted three Yankee Atomic Electric Company (Yankee) reports, YAEC-1849P, YAEC-1854P, and YAEC-1856P, and requested _that they be withheld, pursuant to 10.CFR 2.790, from public disclosure. The affidavit submitted with the-application was incomplete.
In a ' letter dated March 30, 1993, you submitted a revised affidavit.
In the revised affidavit, the Yankee Vice President, Er.gineering Science, stated that the submitted information should be considered exempt from mandatory public disclosure for_ the following reasons:

r (a) The material is of the type customarily held in confidence and not customarily disclosed to the public.
In accordance with a Yankee review process, information that is determined to be~ potentially marketable'or provides a potential competitive advantage is held in confidence.
(b) The information is not available in public sources.
(c) The material contained in the reports contains significant information and detail pertaining to the development'of a methodology' and/or data.
This ~ material, which is marketable in several ways,'was obtained at.
considerable expense to Yankee. The public release of this'information, making it readily available to competitors, would diminish. Yankee's
-l ability to sell products and services involving the use of this:
information.
(e) The use of the'information and data provided in these documents by a competitor would put Yankee ~ at a competitive di', advantage by reducing the competitor's expenditure of resources at the r,xpense of Yankee.

Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this information to our consultants working in this area. We will ensure that the consultants have signed the appropr_iate-agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change such that the information could then be made -available for public inspection, you should notify the NRC promptly. You should also understand that the NRC may have cause to review this determination-in the. future, such as, if the scope of a Freedom of Information Act request includes your information.
In all revieu situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
