Dear Ms. Adensam:
This is in response to John W. N. Hickey's February 4,1993 response to my July 23,1992 letter to Dr. Jerry Swift, regarding a schedular exemption for submittal of a Decommissioning Funding Plan (DFP) for License SNM-414.
B&W is amenable to an increase in the certificate of financial assurance for the Parks Township facilities beyond the current $750,000. B&W proposes that the new amount, to be applicable to the facilities adjacent to the fenced area comprising the 10 CFR 20.304 burial ground (SLDF), should be $2,000,000, if our proposal is acceptable to you, B&W will reflect the $2,000,000 amount in the certificate to be submitted by June 30,1993. We understand that, concurrently, NRC would grant B&W's request for a schedular exemption until July 26,1995 to submit a DFP covering the estimated cost of decommissioning those facilities.
With respect to decommissioning financial assurance and a DFP for the SLDF, and the License SNM-414 renewal, we expect to submit Revision 5 for the renewal application to you on behalf of B&W on or about May 28,1993. This submittal will include revisions updating Revision 4 to current site conditions and operations. Additionally, in recognition of the fact that characterization of the SLDF area has commenced in contemplation of potentially necessary remediation, this submittal is expected to include a request that NRC issue, pursuant to 10 CFR 70.38 and 40.42, a separate license, for administrative convenience, covering possession of the material at the SLDF and permitting characterization activities there. We also intend in the May 28,1993 letter to propose an interim amount for a certificate of financial assurance pertaining to the SLDF, a mechanism for providing such financial assurance involving a third party participant in the project, and a schedular exemption until July 26,1995 for submittal of a DFP.

the third party participant. We will promptly advise you if it appears there will be any significant change in the submittal schedule. Meanwhile, we understand you are willing to accept the financial assurance increase and DFP schedular exemption for the facilities adjacent to the SLDF proposed herein, which, of course, we recognize to be contingent on our completion of the other action items referred to herein. Summary Decommissioning Cost Estimate Getitlemen:
The summary cost estimate for decommissioning the Research and Test Reactor Fuel Element (RTRFE) portion of our facility is enclosed.
To the extent possible, the cost estimate follows the guidance provided in Regulatory Guide 3.66, Appendix F.
Our subcontracts with EG&G Idaho, Inc. and Martin Marietta Energy Systems, Inc. provide coverage for 50 percent of the cost of decommissioning the RTRFE areas between 1990 and 1995. Thereafter, the subcontracts will provide for 100 percent funding of the decommissioning costs without limitations.
Therefore, the total liability for NNFD through 1995 will be 50 percent of the total estimated cost provided in the enclosure.
The Parent Company Guarantee, which was provided to NRC by letter dated June 26, 1992, from E. O. Hooker, will be revised using the summary cost estimate. The revised Parent Company Guarantee will be sent to you when it is complete.
