JUL 7 1993 NOTICE OF VIOLATION New York Power Authority Docket No. 50-333 James A. FitzPatrick Nuclear Power Plant License No. DPR-59 By letter dated May 28,1993, from Mr, H. P. Salmon, Jr., a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure of NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1993), the violation is listed below:
10 CFR Part 55.25 requires that the facility licensee shall notify the Commission within 30 days oflearning of the diagnosis of medical conditions which cause a licensee (licensed operator) to fail to meet the requirements of 10 CFR Part 55.21.
Contrary to the above, one operator in February 1991, and another operator in February 1993 were diagnosed with vision below the requirements of ANSI /ANS 3,4-1983, and were not reported to the NRC until May 1993.
