SUBJECT: EMERGENCY OPERATING PROCEDURE INSPECTION (INSPECTION

REPORT NO. 50-271/93-12)

This letter refers to a special safety inspection conducted by Ms. Tracy E. Walker and other

members of this office on May 11 and May 12,1993, at the Vermont Yankee Nuclear Power

,

Station and to the discussions of our fmdings held by Ms. Walker with Mr. Wanczyck and

other members of your staff at the conclusion of the inspection.

The objectives of the inspection were to address the open items associated with the

Emergency Operating Procedures (EOPs) identified in Inspection Report No. 50-271/92-80

and to review your actions in response to discrepancies related to jet pump operability testing

identified in Examination Report No. 50-271/93-03. The purpose of the inspection was to

determine whether activities authorized by the license were conducted safely and in

accordance with NRC requirements.

Areas examined during this inspection are described in the NRC inspection report, which is

enclosed with this letter. Within these areas, the inspection consisted of selective

examinations of procedures, interviews with personnel, and observations by the inspectors.

In general, the EOPs and Plant Specific Technical Guidelines (PSTGs) were found to be

technically adequate and the majority of the previous concerns related to the technical -

adequacy of the PSTGs, EOPs, and EOP support procedures have been corrected. However,

concerns still exist related to implementation of the RPV Pressure Control mitigation strategy

for conditions that require entry into RPV Control. You are requested to provide a written

response to the concerns identified in section 3.3 and in the third paragraph of section 3.2 of

the enclosed inspection report within sixty days of receipt of this letter.

The verification and validation (V&V) that was performed on the latest revision of the EOPs

and EOP support procedures appears to have been effective. The Procedure Generation

Package has been revised to address the previously identified concerns and to provide

appropriate V&V on the EOP support procedures. You have also taken effective corrective

actions to improve the administrative controls for ensuring that tools and materials are

available for implementation of the EOPs.

Based on the results of this inspection, certain of your activities appeared to be in violation

of NRC requirements, as specified in the enclosed Notice of Violation. The violation is of

concern because it should have been prevented by your corrective actions for a previous

weakness in the surveillance testing program and your failure to recognize the significance of

the event in your identification of the root cause for the failure to complete the jet pump

surveillance during single loop operations.

You are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. In your response, you should document the

specific actions taken and any additional actions you plan to prevent recurrence. After

reviewing your response to this Notice, including your proposed corrective actions and the

results of future inspections, the NRC will determine whether further NRC enforcement

action is necessary to ensure compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and

its enclosures will be placed in the NRC Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject to the clearance

procedures of the Office of Management and Budget as required by the Paperwork Reduction

Act of 1980, Pub. L. No. 96.511.
