This letter refers to the physical security inspection conducted by Mr. E. B. King of this office

on April 19-23, 1993, of activities at the Nine Mile Point Nuclear Station Units 1 and 2,

authorized by NRC License Nos. DPR-63 and NPF-69 and to the discussions of our findings

I

held with Messrs. Abbott, Christensen and others by Mr. King at the conclusion of the

j

inspection.

Areas examined during the inspection are described in the enclosed NRC Region I Inspection

Report. Within these areas, the inspection consisted of selective examinations of security

i

procedures and representative records, interviews with personnel and observations by the

inspector.

!

We found that your physical security program is generally effective and directed toward assuring

i

public health and safety. Management support for the program was evident through the

,

implementation of several program enhancements. However, one of your activities was not

I

conducted in full accordance with NRC requirements, as set fonh in the Notice of Violation,-

enclosed herewith as Appendix A.

The violation involves your failure to satisfy cenain

j

requirements relative to assessment aids contained in your NRC-approved Physical Security Plan.

Tne violation has been categorized by severity level in accordance with the " General Statement

of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C

(Enforcement Policy). You are required to respond to this letter, and in preparing your response,

you should follaw the instructions in Appendix A.

l

During this inspection and two previous inspections of your security program, we identified

j

l

several examples of performance that are uncharacteristic of your previous performance in the

security area. For example, during our inspection in April,1992, we observed intrusion

detection system zone problems existed that were not detected by the security force patrols.

'

Additionally, during our inspection in October,1992, we observed problems with unattended

,

vehicles and inadequate lighting in the protected area. Those observations, combined with the

violation identified during this inspection suggest a declining trend in your overall performance

in this area, and we believe that your attention is required. In your response to this letter, we

would appreciate your assessment of the matter.

Sections of the Notice of Violation and the enclosed inspection report contain details of your

security program that have been determined to be exempt from public disclosure in accordance

i

with 10 CFR 73.21 (Safeguards Information). Therefore, those sections will not be placed in

the NRC Public Document Room and will receive limited distribution. This letter and the

remainder of the Notice and the inspection report will be placed in the Public Document Room,

in accordance with 10 CFR 2.790(a).
