ANSWER.
l The biennial and interim reviews of Agreement States are normally conducted by a Regional State Agreements Officer (RSA0). There is one RSA0 in each of l
NRC's five Regional Offices. They serve as the principal reviewer or, in the case of team reviews, review manager.
The reviews consist of a preliminary evaluation of information provided by the State undergoing review in advance of an actual visit. During the on-site review, additional information about the State's radiation control program is also evaluated. The RSA0 is

responsible for formulating the preliminary findings resulting from the review. The documented findings are submitted for review and approval by the following NRC officials in the Region and Headquarters:

Provide applicable regulatory and legal citations.
ANSWER.
Section 208 of the Energy Reorganization Act of 1974 requires that the NRC submittoCongressaquarteriyreportlistinganyabnormaloccurrencesator associated with licensed facilities. Although Section 208 does not address abnormal occurrences involving Agreement State licensees, NRC requested Agreement State cooperation in providing such information to Congress. The NRC implemented an Agreement State abnormal occurrence reporting system on JJly 1, 1977.
There are no regulatory or legal requirements for Agreement States to report abnormal occurrences to the NRC. Agreement States voluntarily participate in the abnormal occurrence reporting program based on an agreement to exchange information on a periodic schedule.
As stated in our answer in question 2b., the NRC and Agreement States use their best efforts to keep each other informed on matters of mutual concerns.
The Agreement States provide events / incident reports to the NRC. The Office for Analysis & Evaluation of Operational Data (AE00), in coordination with the Office of State Programs (OSP), flags items appearing to reach the level of an abnormal occurrence and, through further communications with the State, a

In order to provide guidance to the staff and to better implement the term
" compatibility," the Office of State Programs in 1984 adopted internal written procedures, " Internal Procedures, B.7 - Criteria for Compatibility Determinations" (Enclosure 1).
In the B.7 internal procedures, NRC rules are categorized according to the degree of uniformity necessary between NRC and Agreement State requirements.
Four categories were established. These four categories address the standards that States would be required to adopt in order to prevent hindrance to interstate comerce and to prevent ineffective comunication on radiation safety matters.
In addition, these categories address areas considered necessary for an effective radiation control program, but provide sufficient flexibility to allow States to address local ccnditions and to foster innovation.

Subsection j(2) was added to Section 274j of the Atomic Energy Act of 1954, as amended, in 1980 by Public Law 96-295 (94 Stat 787). This subsection gives l
the Commission the authority, upon its own motion or at the request of the Governor, to temporarily suspend all or part of its Agreement with a State without notice of hearing if, in the judgement of the Commission, two conditions exist:
(1) an emergency situation exists with respect to any material covered by such Agreement creating a danger which requires immediate action to protect the health and safety of persons either within or outside of the State; and (2) the State has failed to take the steps necessary to contain or eliminate the cause of the danger within a reasonable time after the situation arose. The Commission is only authorized to exercise such authority to the extent necessary to contain or eliminate the danger. Office of State Programs Internal Procedure D.13 (Enclosure 1) provides guidelines for the staff to follow when considering whether or not to recommend that the Commission exercise the authority in Section 274j(2). The guidelines discuss the approach to be taken with the State, the minimum technical criteria, and other factors to be used in the staff's evaluation and cancellation of the temporary suspension. The guidelines stress the importance of NRC staff working with the State and providing technical assistance in dealing with emergency situations and notes that invoking this authority would only be as a

I The Office of State Programs -(OSP) Internal Procedure D.2 (Enclosure 1), deals with the subject of issuing letters to State officials transmitting the results of the NRC reviews of the State's radiation control program.
It should be noted that the findings of each program review are communicated to the State Health Officer, or equivalent (e.g. Commsioner of Health, Director of Health) at a close-out meeting following completion of the review. The i
review letter serves to confirm the findings in writing and to request l
corrective action. The NRC Regional State Agreements Officer (RSA0) prepares the review letter, coordinates with OSP and NRC regional management and transmits it electronically to OSP for review and signature of the Director, OSP. Concurrence is obtained from the respective Regional Administrator, the Office of Nuclear Materials Safety and Safeguards, the Office of General Counsel, as appropriate, the Deputy Executive Director for Nuclear Materials Safety, Safeguards and Operations Support and the Executive Director for

In 1978, Congress amended Section 274 through enactment of P.L.95-604.
Section 274 was amended again in 1980 by P.L.96-295.
Section 274 was amended a third time in 1982 by P.L.97-415.
For each statutory change, describe the changes made in NRC procedures to reflect such change and provide copies of the pertinent SECY papers, Office of General Counsel memoranda, and other materials documenting the incorporation of these statutory changes into NRC regulations, policies, and procedures.
10a) The NRC routinely issues a letter to Agreement State officials communicating the findings of its reviews of Agreement State programs.
These letters are usually issued several months i
after the review is completed and often describe actions taken by the State in the interim period.
Describe the NRC's procedures and parameters for issuance of these letters including timeliness of transmittal and collection of additional information in the interim period, and provide the documentation establishing these procedures and parameters.
