Dear Mr. Chairman:

I would like to advise you that the Comission has asked Judge Alan S.

Rosenthal to assume the supervisory responsibility for all Office of Inspector and Auditor (01A) investigative matters currently pending before the Office of Inspector and Auditor which relate to the Office of Investigations (01). Judge Rosenthal has agreed to undertake this assignment.

Judge Rosenthal is a distinguished attorney and public servant who retired from the NRC on July 29,1988, after 16 years of service as the Chairman of the Atomic Safety and Licensing Appeal Panel. He will have complete independence and the necessary support from the Comission to accomplish this investigative task.

The Consnission's decision was made in response to Congressional expressions 3

of concern regarding the past relationship between OIA and O! and in i

recognition of the need to assure public confidence in the results of the investigation. This decision was made with the full support of the Director of OIA and does not indicate any lack of confidence in her.
