Dear Mr. Gregg:

'This is in response to your letters of April 13, 1990 and April 25, 1990, regarding relief from certain of the upgrade requirements of 10 CFR 73.46 issued November 10, 1988, based on a reduction of your special nuclear material inventory and phase out of operations.

We have determined that your request is reasonable and that your revised security program will continue to meet the general performance requirements of 10 CFR 73.20. The technical basis for this approval is described in Enclosure 1 (CNSI).

We have also determined that the issuance of an exemption for the three upgrades defined in your April 13, 1990, letter is authorized by law and will t

-not endanger life, property or the common defense and security and is otherwise in the public interest.

Accordingly, your request is approved and we are hereby revising and reissuing Paragraph 9.1.A of the physical security portion of the Safeguards Amendment, designated as SG-2, to your License SNM-368 effective upon receipt of.this letter as reflected in Enclosure 2.

Your additional request related to the continuation of the Tactical Response Team will be reviewed after all unencapsulated material has been removed from your site.

Docket No.70-371 1.icense No.-SNM-368 Amendment SG-2 9.0 Physical Protection Requirements For Strategic Special Nuclear Material-(See attachment for a listing of_ approved revisions) 9.1.A The licensee shall follow the physical protection plan entitled "UNC-Naval Products Physical Protection Plan Revision 9A, 9B, and 90," dated June 12, November 1, and December 15,-1989, respectively-as modified by letters dated February 2 and 12,1990, andasfurtherrevisedinaccordancewith10CFR70.32(e),

a). Notwithstanding the commitments made in Paragraph 1.3, page 1-2, the licensee need only provide a protected area boundary consisting of one barrier.

b). Notwithstanding the commitments made in Paragraph 1.3.2, page 1-3, Vehicle Denial Systems, the licensee need not install physical barrier vehicle denial systems for the design basis threat vehicle, c). Notwithstanding the commitments made in Paragraph 8.4.1, page 8-4, the licensee need not conduct tactical response exercises..Instead, prior to January-31, 1991, the licensee shall continue to provide training as required in 10 CFR 73.46 (b)7 and (b)8 as stated ~in the UNC-NP Training and Qualification Plan.
