This refers to the_ team inspection conducted by Messrs. R. E, Baer,

J. B. Nicholas,Dand R. A. Paul during the period January 29 through February 2,

1990, of activities authorized by NRC Operating Licenses DPR-51 and NPF-6 for

Arkansas Nuclear One, Units 1 and 2, and to the discussion of our findings with

you and other members of your staff at the conclusion of the inspection.on

February 2,-1990. . Subsequent'to this inspection,-on April 27,'1990,

Mr. B. Murray of ,the Region'IV staff held a; discussion with Mr. E.~ Bickel .of

l

your staff to provide an update on the inspection findings.

_

Areas _ examined during the inspection included the radiation protection,

radioactive effluent releases, low-level radioactive waste, and radioactive-

materials transportation programs. Within these areas, the inspection-

consisted of-selective examination of procedures and representative records,

interviews with personnel, .and observations by the inspectors.

One of the items. reviewed during this inspection was the access to the Unit 1

emergency diesel generator room which was identified as an NRC concern in=the

" Diagnostic Evaluation Team Report for Arkansas Nuclear One," dated

December _ 21, 1989. The inspectors determined that'you have taken initial

actions to reduce the radiation levels in an overhead drain-line and are -

l

evaluating permanent corrective measures to be implemented. This matter is

,

l'

discussed in,inore detail in paragraph 10 of the enclosed inspection- report.

l'

During this inspection,-.it was found .that certain of your. activities were in

'

violation of NRC-requirements.

Consequently,.you are required to' respond to

these violations, in writ'ing. in .accordance with the provisions of ~

Section 2.201 of the NRC!s." Rules of Practice," Part 2, Title.10,' Code of

Federal Regulations. -Your response should be based on the specifics contained

)

in the. Notice of_ Violation enclosed with this letter.

In addition, your

response to Violation 368/9004-02 should include those actions taken to ensure

that other procedure changes affecting-Technical Specification required

Also during this inspection, it was found that certain of your activities

appeared to deviate from a commitment made to_the NRC.

This item and reference

to the commitment is identified in the enclosed Notice of Deviation. -You are

requested to respond to this deviation in writing.

Your response should be

based on the specifics contained in the Notice of' Deviation enclosed with this'

letter.

In addition to the violations identified by the inspectors, three other

violations were identified by your staff and appropriate corrective action was

taken.

In accordance with 10.CFR Part 2,. Appendix C,.Section V.G.1 of the

NRC!s Enforcement Policy, no citation is being issued for the

licensee-identified violations described in paragraph 14 of the enclosed

i'nspection report.

The other violation-involving'the disposal of radioactive sludge in.the

Russellville Municipal Sewage Treatment System and the disposal of radioactive

waste in your landfill are included in the Notice of Violation. Although these'

violations could have been considered significant, these unauthorized disposals

-

-did not involve significant radiological exposure concerns. Therefore, we view

.these unauthorized disposals of radioactive material as potentially significant

and have cited:these violations at a Severity Level IV.

However, because

adequate corrective actions were taken, no response is' required.

We know that you have devoted considerable attention in order to

.

.

-

make improvements in this area. During this' inspection, we also noted that you

have made improvements in the areas of organization changes, increased

staffing, the purchase of improved health physics equipment and instruments,

and the revision of many radiation protection procedures.

However, some

problems still exist that indicates that continued attention is required in

this~ area.

An unresolved item involving your overall survey program as it pertains to

portal monitor alarms, radiation controlled area exit points, and contamination

release limits that requires further NRC evaluation is identified in

_ paragraphs 8, 9.a and 9.c.

An open item involving housekeeping for-

contaminated tools and equipment is identified in paragraph'9.b.

We have also examined actions you have taken with regard to previously

identified inspection findings. The status of these-items is identified in

paragraph 2 of the enclosed report.

The-response directed by this letter and the accompanying Notices are not

subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Reduction Act of 1980, PL 96-511.
