Exemption to the Appendix R Requirements Granted on October 23, 1981 Re: Vemont Yankee Nuclear Power Station By letter dated October 23, 1981 the Deputy Director of the Office of Nuclear Reactor Regulation granted your request of October 21,1981 for an exempticn to the Appendix R requirements of 10 CFR 50 concerning the oil collection system. The October 23, 1981 letter stated that details would follow by subsequent letter. This letter provides those details.
Appendix R requires installation of recirculation pump oil collection systems of approved design if containment is not inerted during normal operation. Significant personnel exposure would be incurred to install i
an oil collection system at Vermont Yankee. At the time of your request, a new rule (10 CFR 50.44) requiring Vemont Yankee to inert was iminent.
On December 2,1981 the new rule was published in the Federal Register (46 FP. 58484) and on January 4,1982 it became final. The new rule requires that by tiay 4,1982 Vemont Yankee provide an inerted atmosphere for containment. Despite the absence of an approved oil collection system prior to May 4,1982, the staff considered that the presently installed fire protection equipment provides adequate protection. After May 4,1982 10 CFR 50.44 requires that Vemont Yankee containment atmosphere be inerted, and therefore an approved-design oil collection system will not-be required by Appendix R.
