Dear Mr. Lowenstein:
This is in partial response to your letter dated October 15, 1981 in
which you appealed NRC's failure to provide a response to your initial
Freedom of Information Act request of September 18, 1981.
On November 17 and 20,1981 you were provided with a total of seven
documents. Additional documents subject to your request have since been
located. These documents, as listed on the Appendix to this letter, are
enclosed in their entirety with two exceptions. The memorandum dated
December 15, 1980 from G. A. Phillip contains the names of persons the
release of which would constitute an unwarranted invasion of personal
privacy and disclose the identities of confidential sources. These
names are being withheld pursuant to exemption (7)(C) and (D) of the
Freedom of Information Act (5 U.S.C. 552(b)(7)(C) and (D)') and 10 CFR 9.5(a)(7)(iii) and (iv) of the Comission's regulations.
In the OIA
Report Chronology the name of a particular person is being withheld
because disclosure would constitute an unwarranted invasion of personal
privacy. This withholding is being made pursuant to exemption (7)(C) of
the Freedom of Information Act (5 U.S.C. 552(b)(7)(C)) and 10 CFR 9.5(a)(7)(iii).
Additional documents will be addressed by the Commission in a separate
response to you regarding your appeal.
This determination is a final agency action with regard to these documents.
As set forth in the Freedom of Information Act (5 U.S.C. 552(a)(4)(B)),
judicial review of this decision is available in a district court of
