AFFIDAVIT OF JOHN T. MERRITT REGARDING CONTENTION SEVEN (ROCK OVERBREAK)

I, John T. Merritt, being first duly sworn, do depose and state: I am employed by Texas Utilities Services Incorporated in the position of Manager of Engineering and Construction, at Comanche Peak Steam Electric Station (CPSES) and have held that position since June 1, 1979. From June 1,1977 to June 1,1979 I was the Resident Manager of CPSES. As such, I was responsible for all construction activities. My educational and professional qualifications are attached to this affidavit.

This affidavit addresses whether fissure repairs at the Comanche Peak excavation were completed in accordance with the required specifications and procedures.

During my tenure as Resident Manager and Manager, Engineering and Construction all excavation rock wall fissure repairs were completed. Members of my staff identified those remaining grout pipes that were not pressure grouted under the 8201290461 820126 PDR ADOCK 05000445 o PDR

. s direction of Mason-Johnson Associates. Steps were taken to pressure grout these remaining fissures using approved procedures. These repairs were documented and a review of all documentation from identification and mapping of fissures to repair of same was conducted to assure all repairs were completed properly.

Engineering & Construction Manager responsible for all engineering and construction activities for this two unit site.

1977 - 1979 Comanche Peak SES - Texas Utilities Services Inc.

Resident Manager responsible for developing, staffing and controlling the necessary activities to support construction of Comanche Peak. This included field engineering, purchasing, construction, scheduling, planning and project control s.

1972 - 1977 Martin Lake SES - Texas Utilities Services Inc.

Resident Engineer responsible for providing field engineering, planning, scheduling and interface control with the architect-engineer for four 750 MW Lignite fired units including establishing the mining support facilities and transportation.

1968 - 1972 Big Brown SES - Texas Utilities Services Inc.

Office engineer responsible for establishing the necessary support for a field construction office which included purchasing reports, schedules drawing control and civil field activities.

1966 - 1968 U.S. Army Missile & Material Command Redstone Arsenal, Alabama. Civil engineer responsible for developing test programs including conducting research and development tests on prototype missile systems.

1963 - 1966 Dave Johnson SES & Morgan Creek SES - Ebasco as Cadet engineer. Summer employment responsible for civil field work including inspections and surveying.
