SUBJECT:
EMERGENCY RESPONSE CAPABILITY AND FACILITIES We have reviewed your memorandum of December 29, 1981 concerning the above
- subject and fully agree with the stated objective of developing firm basic requirements in this important area.
The package submitted by your memorandum does not include the safeguards as-pects of safety emergencies.
In this connection,10 CFR.73.50(g) requires the submission and approval of safeguards contingency plans in accordance with the_ criteria in Appendix C to Part 73. As noted in the Introductory Section to Appendix C, these contingency plans are intended to be comple-mentary to emergency plans developed pursuant to Appendix E of 10 CFR Part 50.
It is therefore suggested that this be taken into consideration when the Emergency Response Capability paper is revised. Regulatory Guide 5.54 sets forth the standard format and content for safeguards contingency plans for nuclear power plants.
At the present time a study is underway under the aegis of the Office of Research regarding " Security Procedures for Nuclear Power Plants During Safety-Related Emergencies." That study is scheduled for completion by the end of FY 82 and may serve as the basis for revised guidance on this subject.
My staff is also developing rule amendments and supporting guidance designed to facilitate rapid access to vital areas during site

emergencies. These amendments are scheduled to reach the Commission by mid 1982.
It is believed that the accomplishment of these two efforts will result in the generation of material appropriate for inclusion in your overall document addressing the subject of emergency response. We will contact the CRGR at the appropriate time concerning additional inputs as they develop.
