We have received a copy of your application dated November 17,1981, which was filed with the Office of Nuclear Reactor Regulation (ONRR) for review.
This application related to Environmental Technical Specification changes for Calvert Cliffs Unit Hos. I and 2 and included the remittance of fees in the amount of $4,400 per 10 CFR 170. By letter dated December 21, 1931, the Baltimore Gas and Electric Company withdrew the November 17, 1981 application.
Under the provisions of 10 CFR 170.12(a), the USNRC may retain fees for withdrawn applications, llowever, the ONRR review staff has informed us-that no review of your November 17,1981 application had commenced when it was withdrawn. On this basis, we have concluded that an exemption pursuant to 10 CFR 170.11(b) from the fee requirements is hereby authorized by law, and such exemption is otherwise in the-public interest and is hereby granted for this application. Accordingly, we are concurrently authorizing the Office of the Controller to refund $4,400 to you. Refunds are generally processed within a two-week period.
