' Gentlemen:
This refers to the inspection conducted under the ReMdent Inspection Program
by Messrs. M. W. Of ckerson and G. L. Plumlee III.. of this office during the
period November 1-30, 1981, of activities authorized by NRC Operating License
DPR-34, and to discussions of the findings with members of your staff at the
conclusion of the inspection.
Areas examined during the inspection and the findings are discussed in the
enclosed inspection report. Within these areas, the inspection consisted of
selective examination of procedures and representative records, interviews with
personnel, and observations by the inspectors.
During this inspection certain of your activities appeared to be in noncompliance
with NRC requirements, as specified in the enclosed Appendix A.
Violation 1 has
been categorized as a Severity Level III violation according to the NRC interim
Enforcement Policy, 45 FR 66754, dated October 7,1980, This Severtty Level
nomally dictates the imposition of a civil penalty. It is our judgement, how-
ever, that since you had originally identified the violation, reported it, and
are taking appropriate corrective and preventative steps, civil action is not
warranted. You are required to respond to these matters in writing in accord-
ance with the provisions of Section 2.201 of the NRC's " Rules of Practice,"
Part 2. Title 10, Code of Federal Regulations. Your response should be based on
the specifics contained in the Notice of Violation enclosed with this letter.
In addition, we are concerned about the implementation of your program for
management control of your licensed activities that permitted a reoccurrence
of the type of violation discussed in Violation 1 of Appendix 4.
Consequently,
in your reply you should describe, in particular, those actions taken or planned
to improve the effectiveness of your management control of the requirements of
your license.
In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosures
will be placed in the NRC Public Document Room unless you notify this office
by telephone, within 10 days of the date of this letter and submit written
application to withhold infomation contained therein within 30 days of the
date of this letter. Such application must be consistent with the requirements
